TOWN OF EDGECLIFF ORDINANCE N0.~87-04
CITY OF FORT WORTH ORDINANCE NO
JOINT ORDINANCE AND BOUNDARY AGREEMENT
WHEREAS the City of Fort Worth is a home rule city located m Tarrant, Wise, and
Denton Counties, Texas, and
WHEREAS the Town of Edgechff Village > a general law city located m Tarrant
County Texas, and
WHEREAS Fort Worth and Edgechff Village share a common boundary and
WHEREAS Section 43 031 of the Texas Local Government Code authorizes adjacent
mumcipahties to make mutually agreeable changes m their boundaries of areas that are less than
1 000 feet in width, and
WHEREAS Fort Worth and Edgechff Village now desire to adjust their corporate
boundary lines, whereby Fort Worth will release from its corporate limits land to be relinquished
to and become part of the corporate limits of Edgechff V>llage, and Edgechff Village w>ll release
from its corporate 1>mrts certain other land described herein to be relinqu>shed to and become
part of the corporate hmrts of City of Fort Worth, and
WHEREAS the areas subject to the boundary adjustment is less than 1 000 feet m
width.
NOW THEREFORE, BE IT ORDAINED AND MUTUALLY AGREED BY THE
CITY COUNCIL OF THE TOWN OF EDGECLIFF VILLAGE AND THE CITY
COUNCIL OF THE CITY OF FORT WORTH
SECTION 1
Pursuant to Section 43 031 of the Texas Local Government Code, the Town of Edgechff
V>llage and the City of Fort Worth hereby agree that the boundary between the cities w>ll be

adjusted as set out herein, and deplcted on Exhibit A wh>ch Is attached hereto and
incorporated herein for all pursposes.
SECTION 2.
In accordance with the terms of this Joint Ordinance and Boundary Agreement, the Town
of Edgecllff Village hereby rehnqulshes approximately 14 02 acres depicted as Tract 1B on
Exhibit A to the City of Fort Worth and dlsannexes and discontinues such property as a part of
the Town of Edgechff Village. The Clty of Fort Worth accepts and annexes Tract 1B depicted
on Exhibit A Into its corporate llmrts
SECTION 3
In accordance with the terms of thls Joint Ordinance and Boundary Agreement, the Clty
of Fort Worth hereby rellnqulshes approxlmately 9 acres described as Tract 2A on Exhibit A to
the Town of Edgecllff Village and dlsannexes and dlscontlues such property as a part of the
City of Fort Worth. The Town of Edgecllff Vlllage accepts and annexes Tract 2A deplcted on
Exhibit A into Its corporate llmrts
SECTION 4
Thls ordlnance shall be cumulatlve of all provlslons of ordinances of the Town of
Edgechff Village and the Crty of Fort Worth, except where the provlslons of thls ordinance are In
direct conflict with the provlslons of such ordinances, m which event the confllctmg provlslons
of such ordinances are hereby repealed.
SECTION 5.
It Is hereby declared to be the Intention of the City Councils of Edgecllff Village and Fort
Worth that the phrases, clauses, sentences, paragraphs and sections of this ordlnance are

severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be
declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted without the
incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph
or section.
SECTION 6.
The Town of Edgechff Village and the City of Fort Worth do hereby covenant and agree
to protect, preserve and defend the herein described boundary adjustment.
SECTION 7
The City of Fort Worth and the Town of Edgechff Village agree and ordain that the
adoption by both cities of this Joint Ordinance and Boundary Agreement, and the boundary
change resulting therefrom, do not mitigate, diminish or lessen m any way the rights that either
party may have, at law or in equity to challenge or contest any other annexations, attempted
annexations or extraterritorial jurisdiction claims made by the other party
SECTION 8.
This Joint Ordinance and Boundary Agreement shall become effective and shall become a
binding agreement upon the Town of Edgechff Village and the City of Fort Worth by the
adoption of same m regular open city council meetings of the Town of Edgechff Village and the
City of Fort Worth.

SECTION 9
This Joint Ordinance and Boundary Agreement, upon adoption by both cities, shall be
executed m duplicate ongmals by the Mayor of each city

BEING a tract of land situated in the G. Herrera Survey Abstract No 2027 in the Town
of Edgecliff Village, Tarrant County Texas, and being part of Tract One described in
deed to Louisiana Hunt Petroleum Corporation recorded in Volume 8012, Page 129 of
the Deed Records of Tarrant County Texas, and being more particularly described as

COMMENCING at a point for the intersection of the westerly right-of--way line of
Hemphill Street (aka Village Parkway (variable width ROW) with the northerly right-of-

Joint Ordinance and Boundary Agreement with the Town of Edgecliff Village to Adjust the Boundary
between Fort Worth and Edgecliff Village at the Corner of Alta Mesa Boulevard
RECOMMENDATION
It is recommended that the City Council.
1 Approve the attached Joint Ordinance and Boundary Agreement with the Town of Edgecliff Village in
connection with the Villages of Edgecliff Development project; and
2. Authorize the Mayor to execute the attached Joint Ordinance and Boundary Agreement.
DISCUSSION
On February 17 and 25 2004 staff met with Paul Cheng and Fredric Silver representing the Villages of
Edgecliff Development Project. The proposed 199 acre development is located north of Alta Mesa
Boulevard and on both sides of Hemphill Street (Village Parkway) The southernmost 17 62 acres are
located in the City of Fort Worth To facilitate the development of the two commercial tracts along Alta
Mesa Boulevard it is proposed to move approximately 14 02 acres west of Hemphill Street presently
located in the Town of Edgecliff Village to within the Fort Worth city limits On the eastern tract at the corner
of Hemphill and Alta Mesa Fort Worth would release approximately 9 acres to Edgecliff Village. This action
would allow the commercial tracts to be developed under the guidelines of one city Exhibit A provides a
map of the proposed boundary adjustment and legal descriptions
On April 8 2004 the Town of Edgecliff authorized this transfer and add an addition tract located at 2000
Alta Mesa Boulevard (northwest corner of Crowley Road and' Ala Mesa Boulevard) to the adjustment. The
additional tract is not part of the Villages of Edgecliff Development Project.. For that reason staff does not
recommend the adjustment to include the 2000 Alta Mesa tract. Should council desire to consider the
transfer of this tract, it should be considered as a separate action
Section 43 031 of the Texas Local Government Code authorized adjacent municipalities to make mutually
agreeable changes in their boundaries of areas that are less than 1 000 feet in width Approval of the Joint
Ordinance and Boundary Agreement will result in movement of approximately 14 02 acres from Edgecliff
Village to Fort Worth Additionally Fort Worth would allow 9 acres presently located in the City of Fort
Worth to be transferred to the Town of Edgecliff
The property would be an addition to Council District 6
