HomeMy WebLinkAboutOrdinance 16067 Ordinance No. ~ 6 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $347,200 SUBJECT TO EXECUTION OF AN INTERLOCAL AGREEMENT WITH THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY FOR THE PURPOSE OF FUNDING THE OPERATION OF NINE WHOLE AIR SAMPLERS MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS• SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004-2005 there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $347,200 subject to execution an Interlocal Agreement with the Texas Commission on Environmental Quality for the purpose of funding the operation of nine Whole Air Samplers. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1 2004 and ending September 30, 2005, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shalt take effect upon adoption. APPROVED AS TO FORM AND LEGALITY M Assistant Cit Attorney ' ADOPTED AND EFFECTIVE. ~ ~ ~ oL City of Fort Worth, Texas Mayor and Council Communication SUBJECT Approval of Interlocal Agreement with the Texas Commission on Environmental Quality for the Operation of Local Air Pollution Monitors RECOMMENDATION It is recommended that the City Council 1 Authorize the City Manager to execute an interlocal agreement with the Texas Commission on Environmental Quality (TCEQ) for the operation of nine Whole Air Samplers by the City of Fort Worth at nine sites The agreement amount is $ 347,200 for the year FY 2004-2005 and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $ 347,200 in FY 2004-2005; subject to receipt of an executed interlocal agreement. DISCUSSION In 2003 the United States Environmental Protection Agency launched a new air monitoring network. The Texas Commission on Environmental Quality has been designated as the administering agency Since the inception of this new monitoring program the TCEQ has contracted with the City for operation and maintenance of the monitoring equipment. The City will be responsible for retrieving the sampling data sending it for analysis and performing regular maintenance activities on the equipment under the terms of this agreement.
