HomeMy WebLinkAboutOrdinance 15869ORDINANCE NO ~OJ ~`~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND `"~ APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $97 451.80 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING CHANGE ORDER NO 3 TO CITY SECRETARY CONTRACT NO 28773 WITH OMEGA CONTRACTING, INC. FOR WATER AND SANITARY SEWER REHABILITATION REPLACEMENT CONTRACT 2001 STM-L, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 2003/04 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Fund in the amount of $97 451.80 from available funds for the purpose of funding Change Order No. 3, to City Secretary Contract No 28773 with Omega Contracting, Inc. for Water and Sanitary Sewer Replacement Contract 2001 STM-L. SECTION 2. Should any portion, ection or part of a section of this ordinance be declared invalid, inoperative void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 15636 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $97 451 80 from available funds, and 3 Authorize the City Manager to execute Change Order No 3 to City Secretary Contract No 28773 with Omega Contracting Inc. in the amount of $97 451 80 for additional and increased pay item quantities, thereby increasing the contract amount to $1 029,231 49 DISCUSSION On April 29 2003 (M&C C-19558) the City Council authorized the City Manager to execute a contract with Omega Contracting Inc. in the amount of $909,247 69 for Water and Sanitary Sewer Replacement Contract 2001 STM-L. The contact was subsequently revised by two change orders as follows. Change Order No 1 provided 60 additional calendar days to construct the project; and Change Order No 2, in the amount of $22 532.00 provided for the replacement of a 260 foot segment of a previously unknown severely deteriorated sewer lateral that was encountered during construction at the immediate downstream end of a project sewer lateral (L 11780) This project includes replacement of the existing undersized deteriorated water main located on Grayson Street from Cravens Road to the IH-820 frontage road Currently the City does not provide sanitary sewer service on the street, which has several vacant lots and the existing residences utilize private septic tanks. The street is scheduled for reconstruction by the Transportation and Public Works Department after the water main is installed It is anticipated that the majority of the vacant lots on the street will be developed once the water main is replaced In order to avoid cutting new street pavement in the near future to install a sanitary sewer lateral staff recommends the sewer line be installed in conjunction with this project. The existing residents on the street will be offered the opportunity to connect to the sewer main Staff considers the proposed change order amount to be fair and reasonable and recommends approval Logname 30STML CHANGE 3 Pale 1 of 2 Omega Contracting Inc. is in compliance with the City's M/WBE Ordinance by committing to an additional 17% M/WBE participation on this Change Order No 3 The City's goal on this change order is 17% This project is located in COUNCIL DISTRICTS 5 Mapsco 79Y and Z.
