AN ORDINANCE AMENDING THE CODE OF THE CITY OF
FORT WORTH (1986), AS AMENDED, BY AMENDING CHAPTER 34
`VEHICLE FOR HIRE" ARTICLE IV GROUND TRANSPORTATION"
SECTION 245 AGE LIMITS OF TAXICABS, OTHER VEHICLE
REQUIREMENTS SUBSECTION (A) BY PROVIDING THAT
PERMITTED AND AUTHORIZED TAXICAB VEHICLES THAT ARE
FIVE YEARS OLD ON JANUARY 1 2004 SHALL BE ALLOWED TO BE
PERMITTED AND AUTHORIZED TO OPERATE IN FORT WORTH
UNTIL DECEMBER 31 2004, PROVIDING THAT THIS ORDINANCE IS
CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE PROVIDING
A FINE OF UP TO $200 FOR EACH OFFENSE IN VIOLATION OF THE
ORDINANCE PROVIDING A SAVINGS CLAUSE, AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS
SECTION 1
THAT Chapter 34 `Vehicles for Hire Article IV `Ground Transportation Section 245
Age hmrts of taxicabs, other vehicle requirements" subsection (a) is amended as follows.
`(a) Effective January 1 1996 no taxicab may be over five (5) years old as
calculated from the first day of January of the model year of the vehicle,
except that a taxicab that is permitted and authorized to operate under this
Article and is five years old on January 1, 2004 shall be allowed to be
permitted and authorized to operate in Fort Worth until December 31,
2004. No vehicle more than four (4) years old, as calculated above, maybe
added to the fleet. As vehicles in operation become older than this
provision, they shall be removed from the fleet.
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m

direct conflict with the provisions of such ordinances and such Code, m which event conflicting
provisions of such ordinances and such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaimng phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation m this ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined
not more than Two Hundred Dollars ($200 00) for each offense. Each day that a violation is
permitted to exist shall constitute a separate offense.
SECTION 5.
All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and
all violations of the provisions of the ordinances amended m Section 1 which have accrued at the
time of the effective date of this ordinance and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or not, under such ordinances, same
shall not be affected by this ordinance but may be prosecuted until final disposition by the courts.
SECTION 6.
The City Secretary of the Crty of Fort Worth, Texas, is hereby directed to publish the
caption and Section 4 of this ordinance for two (2) days m the official newspaper of the City of
Fort Worth, Texas, as authorized by Section 2, Chapter XXV of the Charter of the City of Fort
Worth, Texas and by Section 52.013 Texas Local Government Code.
SECTION 7
This ordinance shall be m full force and effect after its passage and publication as required
by law and rt is so ordained.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance amending Chapter 34 "Vehicles for
Hire Section 245 Age Limits of taxicabs other vehicle requirements subsection (a) to allow cone-year
extension on the age limits for authorized and permitted 1999 taxicab vehicles
DISCUSSION
Ground Transportation Hire Ordinance No 15655 as amended on September 1 2003 (M&C G-14064)
regulates commercial vehicles for hire operating on Fort Worth public streets alleys and public
thoroughfares Section 34-245(a) of the City Code specifies that in order to be permitted to operate in the
City of Fort Worth a taxicab may not be older than five (5) years old as calculated from the first day of
January of the vehicle model year As vehicles in operation become older than allowed under this
provision they are to be removed from the fleet.
In February 2003 the City of Dallas and the Dallas-Fort Worth International Airport (DFW) granted aone-
year extension for taxicabs already in service prior to February 26 2003 The extension applies- regardless
of the age of the taxicab
On January 27 2004 staff received City Council direction to move forward with cone-year age limit
extension.that applies only to 1999 vehicle models authorized to operate as of December 31 2003
