ORDINANCE NO. (W ~ ~~
AN ORDINANCE VACATING AND EXTINGUISHING AN
APPROXIMATELY 20-FOOT WIDE BY 224.25-FOOT LONG ALLEY
LOCATED IN BLOCK 6 OF THE BOAZ SUMMIT ADDITION, FORT
WORTH, TARRANT COUNTY TEXAS; PROVIDING FOR REVERSION
OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN
ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That an approximately 20-foot by 224.25 foot long alley located in Block 6 of the Boaz
Summit Addition, beginning at the northwest corner of Lot 8 and the south line of right-of--way
of East Broadway Avenue, running along the west property lines of Lots 8, 7 6 and 5-R and the
east property hues of Lots 1 2, 3 and 4-R, and the north property lines of Lots 3-R and 1-R,
Block 5 containing approximately 4,500 square feet, as recorded in Volume 63, Page 85 of thte
Plat Records of Tarrant County Texas, and as more specifically described in Exhibit A attached
hereto and incorporated herein by reference be and the same is vacated and extingwshed.
SECTION 2.
That the fee to the land in the above-described vacated alley is hereby released and shall
revert to the adjacent owner as provided bylaw
SECTION 3.
A twenty-foot utility easement will be dedicated an the replat at the location of the alley
and said easement shall be retained by the City until such time all utilities located in that
easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances m conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Being a portion of the alley originally dedicated. for Block 6, Boaz Summit Addition and
addition to the City of Fort Worth and being more pmRiculatly described as follows:
BEGINNING at the northwest corner of Lot 8, Block 6, Boaz Summit Addition '
according to Plat recorded in Volume 63, Page 85 of the Plat Records of Tarrant County,
Texas said point also being in the south lice of right-of-way for East Broadway Avenue;
THENCE south 00 degrees 00 minutes 04 seconds west along the west line of Lots 8, 7,
6, and S-R of Brock 6, Boaz Summit Addition for a distance of 224.36 feet to a point in
the .north line of Lot 3-R, Block 5, Boaz Summit Addition according to Plat recorded in
Volume 388-90, Page 29, Plat Records of Tenant County, Texas;
THENCE north,89 degrees 46 minutes 56 seconds west along the north line of Lots 3-R
and 1-R, Block S, Boaz Summit Addition fora distance of 19.79 feet to a point;
THENCE north 00 degrees 13 minutes 18 seconds west along the east line of Lot 4-R,

VA-04-036 Alley Vacation Adoption of Ordinance Vacating an Alley in Block 6 of the Boaz Summit
Addition Containing Approximately 4 500 Square Feet
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating an alley in Block 6 of the
Boaz Summit Addition as recorded in Volume 63 Page 85 of the Plat Records of Tarrant County Texas,
from the south right-of-way line of East Broadway to a point at the South property line of Lots 1-R and 3R,
Block 5 Boaz Summit addition being approximately 224.25 foot long and 20 foot wide and containing
approximately 4 500 square feet.
DISCUSSION
Adoption of the attached ordinance would vacate an alley in Block 6 of the Boaz Summit Addition from the
south right-of-way line of East Broadway to a point at the South property line of Lots 1-R and 3R, Block 5
Boaz Summit addition being approximately 224.25 foot long and 20 foot wide and containing approximately
4 500 square feet.
Bill Boomer of LandCon acting on behalf of Bill Renfro CEO for Renfro Foods, Inc, has requested
vacation of the above referenced alley in order to incorporate the land in a replat; the alley will be dedicated
on the replat as a 20-foot utility easement and a note shall be placed on the plat providing that no buildings
or structures shall be constructed over an existing water sanitary sewer or utility easement. The
Engineering Department, Real Property Services Division, states that a fee of $433 80 will satisfy the public
interest. Reviewing City departments and public utility companies have raised no objections to this request.
The City Plan Commission recommended approval of this request at its meeting on August 25 2004 An
acceptable replat (FS-04-207) has been received
