BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 Exhibit A, Land Use Assumptions for Water incorporated by reference into Section 35-70.2(a) of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit A, attached hereto SECTION 2. Exhibit B Land Use Assumptions for Wastewater incorporated by reference into Section 35 70.2(b) of the Code of the Crty of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit B, attached hereto SECTION 3 Schedule 1 the Maximum Assessable Impact Fee per Service Umt, incorporated by reference into Section 35-70.3(a) of the Code of the City of Fort Worth (1986), as amended, is herby amended and, after having been so amended, and shall be and read as show on Schedule 1 attached hereto SECTION 4 Schedule 2, Collection Schedule, incorporated by reference into Section 35- 70.3(B) of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Schedule 2 - A, which is to be effective from May 18 2004 until August 15 2004 and on Schedule 2 - B, which is to be effective from August 16, 2004 until May 18, 2009 both of which schedules are attached hereto SECTION 5. Exhibit C Water Benefit Area, incorporated by reference into Section 35-71(a) of the Code of the City of. Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit C, attached hereto SECTION 6. Exhibit D Water Capital Improvements Plan, incorporated by reference into section 35 72(a) of the Code of the City of Fort Worth (1986), as amended, is herby amended and, after having been so amended, shall be and read as shown on Exhibit D attached hereto SECTION 7 Exhibit E, Wastewater Benefit Area, incorporated by reference uito Section 35- 76(a) of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit E, attached hereto SECTION 8. Exhibit F Wastewater Capital Improvements Plan, incorporated by reference into Section 35-77(a) of the Code of the City of Fort Worth (1986), as amended, is hereby amended and, after having been so amended, shall be and read as shown on Exhibit F attached hereto SECTION 9 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 10. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdichon, such unconstitutionality shall not affect any of the remaimng phrases, clauses, sentences, paragraphs and section of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. The CAC met on December 4 2003 January 29 2004 April 9 2004 and April 29 2004 to discuss the updated Land Use Assumptions Capital Improvements Plan and the Impact Fee Ordinance for Water and Wastewater The State Statue requires that the original Impact Fees Ordinance and any amendments to it be reviewed every five years and be amended as necessary to reflect any changes in the Land Use Assumptions, Capital Improvements Plan and the Impact Fee Staff will review the collection ratio with the CAC on an annual basis and will seek Council consideration of any proposed modification On May 11 2004 (M&C G-14360) the City Council conducted a public hearing regarding the proposed amendments to the Land Use Assumptions Capital Improvements Plan and Impact Fee Ordinance.
