HomeMy WebLinkAboutOrdinance 18942-12-2009ordinance No. 18942-12-2009 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPR4PRIATI~NS IN THE STREET IMPRGVEMENTS FUND IN THE AMOUNT 4F $41,DOD.OO AND FRGM AVAILABLE FUNDS, T4 COVER THE ADDITIGNAL COST flF ADDED SIDEWALK L4CATI~NS FOR SIDEWALK REPLACEMENT CONTRACT SP-4; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS GRDINANCE CUMULATIVE CF PRIOR ORDINANCES AND REPEALING ALL PRIER ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL CF THE CITY CF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2009-2010 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Street Improvements Fund in the amount of $41,DDO.00 from available funds, to cover the additional cost of added sidewalk locations for Sidewalk Replacement Contract SP-4. SECTIGN 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning Gctober 1, 2009, and ending September 3D, 20'!D, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Red Light Enforcement Program Fund by $41,000.00 and decreasing the unreserved, undesignated fund balance by the same amount; 2. Authorize the transfer of $41,000.00 from the Red Light Enforcement Program Fund to the Street Improvement Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Street Improvements Fund by $41,000.00 from available funds; and 4. Authorize the City Manager to execute Change Order No. 2 in the amount of $51,554.29 to City Secretary Contract No. 31.681 with Advanced Paving Acquisition, Ltd., dlbla Advanced Paving Company, to cover the additional cost of added sidewalks increasing the total of Contract Renewal No. 1 to $346,554.29. DISCUSSION: Gn August 26, 2008, ~M&C C-22993} the City Council authorized the City Manager to execute Renewal Gption No. 1 to sidewalk contract Group 4 with Advanced Paving Acquisition, Ltd., dlbla Advanced Paving Company, as part of the 2004 Capital Improvement Program ~CIP}Safe Pathway Program. Change Grder No. 1 allowed for the addition of reflective material to ADA ramps that were to be retrofitted with the material. Change Grder No.1 reduced underutilized pay items and introduced a new pay item for the reflective surface to be applied to the retrofitted ADA ramps for a net zero dollar change to the original contract. Change Order No. 2 would allow payment for additional sidewalk locations at Dolores Huerta Elementary School and Wedgewood Middle School. Funding for Change Order No. 2 will be partially covered through the automated Red Light Enforcement Program Fund. M&C G-16627 (Approved on July 14, 2009), this M&C allows for the expenditures of the Red Light Enforcement Program Fund for Sidewalk Construction in the vicinity of schools as a safety measure. No expenditures were made in Fiscal Year 2009 thus a supplemental appropriation needs to be made in Fiscal Year 2010. The balance of Change Order No. 2 Logname: 20S I DEWALKGRP4RENT 1 Cn-2 Page I of 2 will be funded by Safe Pathway CIP Program. Staff considers the change order dollar amount to be fair and reasonable. Advanced Paving Aquisition, Ltd., is in compliance with the City's MIWBE ordinance by committing to an additional ten percent MIWBE participation on this Change order No. 2. The City's goal on this change order is seven percent. FISCAL INFORMATION 1 CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budget, as appropriated, of the Street Improvements Fund.
