HomeMy WebLinkAboutOrdinance 1618710 29 04A1 "i 49 RCVD ORDINANCE NO AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS IN THE POLICE DEPARTMENT INCREASING AUTHORIZED POSITIONS BY TWENTY FOUR, PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE ADOPTION AND IMPLEMENTATION OF THIS ORDINANCE PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE PROVIDING A SEVERABILITY CLAUSE PROVIDING FOR ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN WHEREAS the Police Chief has requested the City Council to readjust and thereafter specify the total number of authorized civil service positions at the police officer rank m the Police Department into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the Police Department; and WHEREAS on September 14 2004 the City Council approved the most recent ordinance concerning the authorized and budgeted positions for the Police Department. In that Ordinance, the Council adjusted the Police Department's civil service staffing, effective October 1 2004 as follows Deputy Chief 5 Captain 12 Lieutenant 46 Sergeant 129 Corporal/Detective 185 Police Officer 934 Total 1,311 WHEREAS in the budget plan approved for fiscal year 2005 funds were approved for 24 additional officer positions, two fewer corporal/detective positions, and two additional sergeant positions and WHEREAS pursuant to Chapter 143 021 (a), Texas Local Government Code, the City Council may prescribe the authorized number of positions m each classification (rank) and the correct number of budgeted civil service positions by ordinance, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That, effective on October 16 2004 the following positions shall be the only civil service positions in each classification (rank) authorized in the City of Fort Worth Police Department for the remainder of the fiscal year 2004-2005 or until modified by subsequent ordinance Deputy Chief 5 Captain 12 Lieutenant 46 Sergeant 131 Corporal/Detective 183 Police Officer 960 Total 1,337 SECTION 2 The `Mayor and Council Communication memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the Council in their adoption as well as the Department's implementation of this ordinance SECTION 3 The additional two sergeant positions and the two deleted corporal/detective positions will both exist for a period of time After the promotion of the next two eligible corporal/detectives to sergeants, two eligible officers will be promoted to sergeants, immediately demoted, and placed on a reinstatement list that will be m effect until he or she is promoted into the next vacant corporal/detective positions, or for one year whichever comes first. SECTION 4 This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the Crty of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. SECTION 5 It is hereby declared to be the intention of the Crty Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5 This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY Assistant Crty Attorney Date `~ D~`7 ~~ y ADOPTED ~ ~ ~ ~ ~ ~- EFFECTIVE City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 10/26/2004 Ordinance No 16187 DATE Tuesday October 26 2004 LOG NAME 35STAFFING REFERENCE NO G-14563 SUBJECT Civil Service Staffing Ordinance Increasing Authorized Strength by 24 Officers and Two Sergeants and Decreasing the Authorized Strength by Two Corporal/Detectives RECOMMENDATION It is recommended that the City Council adopt the attached ordinance specifying the authorized positions in the Police Department, increasing the number of authorized positions by 24 officers and two sergeants and decreasing the number of authorized positions by two corporal/detectives DISCUSSION During the FY2004-2005 budget preparation process, the following sworn assignments were approved for the Police Department with only partial year funding Gang Unit: 13 officers, 1 corporal, and 2 sergeants (General Fund) Patrol Growth. 7 officers (General Fund) School Security Initiative 2 officers (Crime Control and Prevention District Fund) The actual strength of the department will not increase until December 2004 when the next recruit class is expected to graduate and funding was planned accordingly However the School Security Initiative positions and the Gang Unit positions are already filled with. the Field Operations Bureau using budgeted overtime to backfill patrol officers to offset the vacancies The City staffing ordinance that accompanied the adopted budget did not include any of these position increases since they are not funded until December However the Police Department has determined that it is in the best interest of the department and most cost effective to make the permanent promotions of the two sergeants and the corporal now This will allow permanent supervisors to assume their assignments and the overtime funding to be used for three additional patrol officers. The non-promotional officer positions can be created at anytime so they are included in the ordinance under consideration In addition the Fort Worth Police Department has been notified of an award of a State grant for one corporal/detective for Cold Cases. This ordinance also creates a position for this assignment. Throughout the budget process, City staff has indicated that the Police Department will begin phasing out all corporals in the Field Operations Bureau as promotional positions are created Justex recommended and City staff agrees that the field training officers as promotional corporal/detective positions do not allow the selection of the best trainers. As a result, 24 of the 36 positions in this assignment will gradually be transferred to other detective assignments as they are created and replaced with officer positions that will earn an assignment pay when they have a new officer assigned to them This plan was researched with the assistance of the Police Officers Association The result in this City staffing ordinance is that rather than the creation of two corporals and 22 officers two corporals will promote to sergeant and not be T nrrnamv Z SCT O FFTT~T(; Uonn 1 .,f 7 replaced two corporals will be reassigned to Gang and Cold Case and 24 officer positions will be created The Police Department's authorized strength is 1 311 Upon approval of the attached ordinance the two additional sergeants and the two deleted corporal/detectives will both exist for a period of time After the promotion of the next eligible Detective/Corporals to Sergeant, two eligible officers will be promoted to Corporal/Detective immediately demoted and placed on a reinstatement list that will be in effect until he or she is promoted into the next vacant Corporal/Detective positions or for one year whichever comes first.
