HomeMy WebLinkAboutOrdinance 16193Ordinance No. F v ~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT FUND IN THE AMOUNT OF $49,375 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING TRANSPORTATION AND DISPOSAL SERVICES FROM INDEPENDENT ENVIRONMENTAL SERVIVCES OF TEXAS, INC FOR REMOVAL OF NON-HAZARDOUS DEMOLITION DEBRIS; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS' SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager there shall also be increased estimated receipts and appropriations in the Environmental Management Fund in the amount of $49,375 from available funds for the purpose of funding transportation and disposal services from Independent Environmental Services, Inc. for removal of non-hazardous demolition debris. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 11/2/2004 Ordinance No 16193 DATE Tuesday November 02 2004 LOG NAME. 52TEXASTANNING REFERENCE NO P 10034 SUBJECT Appropriation Ordinance to Purchase Transportation and Disposal Services from Independent Environmental Services of Texas Inc for Removal of Demolition Debris from 3700 North Grove Street RECOMMENDATION It is recommended that the City Council: 1) Approve the transfer of $49 375 from undesignated funds in the Environmental Management Operating Fund to the Environmental Management Project Fund 2) Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project funds in the amount of $49 375 from available funds and 3) Authorize the City Manager to pay Independent Environmental. Services of Texas Inc. $91 875 ($87 500 plus a five percent contingency of $4 375) for the transportation and disposal of non- hazardous demolition debris at 3700 North Grove Street which is the location of the abandoned Texas Tanning rendering plant. DISCUSSION In July 2003 the City began working towards cleaning up and/or demolishing the old Texas Tanning facility located at 3700 North Grove Street. The Code Compliance Department secured the property by installing a perimeter fence, and monitored the fence for vandalism repairing it when needed The property has been abandoned for several years, following the bankruptcy of the owner and has since been the scene of several major fires of a suspicious nature The facility is located adjacent to a residential neighborhood and has posed a threat to both residents in the area and City of Fort Worth emergency response personnel. There are drums of hazardous wastes and substances located throughout the property aboveground storage tanks and pits containing waste water and sludge of a currently undetermined nature The Environmental Management Department contacted the Texas Commission on Environmental Quality (TCEQ) in December 2003 to see if they would be able to remove the hazardous wastes and substances from the property After TCEQ toured the site they contacted the Environmental Protection Agency (EPA) for assistance EPA performed extensive sampling of the abandoned hazardous wastes on site in August 2004 In September the City was notified that EPA Region 6 would begin a removal action of the bulk materials from the site. Its operation began on October 11 2004 On October 15 2004 the City and EPA met to discuss issues at the site and to determine partnership opportunities between the two entities for the site cleanup The structural integrity of the numerous buildings on site was of concern to the EPA, because much of the waste cannot be accessed without T.llOnamP S~TFXACTANI~TTN(`, p„rP ~ ,~f7 entering the buildings The City agreed to hire a structural engineer to assess the condition of the buildings After touring the facility it was his determination that a large portion of the facility is structurally unsound and in danger of imminent collapse The EPA contractor had to cease some of its operations on site as a result.
