HomeMy WebLinkAboutOrdinance 16197 Ordinance No ~~ AN ORDINANCE INCREASING APPROPRIATIONS IN THE GENERAL FUND DEPARTMENT OF POLICE IN THE AMOUNT OF $50,983 AND DECREASING APPROPRIATIONS IN THE GENERAL FUND DEPARTMENT OF PUBLIC HEALTH BY THE SAME AMOUNT FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE POLICE DEPARTMENT MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2004- 2005 in the Budget of the City Manager there shall also be increased appropriations in the General Fund, Department of Police in the amount of $50,983 and decreasing appropriations in the General Fund, Department of Public Health by the same amount, for the purpose of transferring said funds to the Police Department. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair -the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 16061 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption. A ~2OVED AS.~TO FORM AND LEGALITY A rney ADOPTED AND EFFECTIVE. ~I~.~,m' `'1; ~~ City of Fort Worth, Texas Mayor and Council Communication COUNCIL ACTION Approved on 11/9/2004 Ordinance No 16197 DATE Tuesday November 09 2004 LOG NAME. 03ANIMALCRUELTY REFERENCE NO *G-14575 SUBJECT Appropriation Ordinance Increasing Appropriations in the Police Department and Decreasing Appropriations in the Public Health Department by the Same Amount to Fund Investigations of Serious Animal-Related Offenses RECOMMENDATION It is recommended that the City Council adopt the attached appropriation ordinance increasing appropriations by $50 983 in the Police Department's General Fund Budget and decreasing appropriations by the same amount from the Public Health Department's General Fund Budget to fund investigations of serious animal-related offenses. DISCUSSION The Animal Care and Control Division of the Public Health Department currently includes two positions for Animal Cruelty Investigators (ACI) to investigate animal-related offenses with a penalty higher than a Class C Misdemeanor Because the Animal Cruelty Investigators (ACI) personnel could not be commissioned as peace officers, one of the positions in the Health Department will be deleted and one detective position will be added in the Police Department. The other position remains with the Animal Care and Control Division as a non-sworn non-commissioned assignment. The sworn position will be placed in one of the Police Department's Field Operations Bureaus detective units This position will assume the responsibility for animal cruelty investigations in addition to general investigative duties. The geographic distribution of the investigative function prevents the centralization of this particular crime Animal cruelty offenses are investigated at all four field operations divisions based on the location of the crime Also the workload does not require the full-time attention of a detective However processes have been put into place for the Police Department to more diligently assist the Animal Cruelty Investigators (ACI) with investigations of serious animal-related offenses. Class C misdemeanor cases will be investigated and filed with the Municipal Court by the Animal Cruelty Investigator (ACI) This collaboration between the Public Health and Police departments establishes a working partnership where animal-related offenses are investigated effectively and thoroughly The Police Department has appointed detectives as liaisons to field inquiries on animal-related offenses from Animal Cruelty personnel and included animal cruelty in the Police Department's offense reporting system Animal Cruelty personnel were given access to the police reporting system through Direct Entry Computer Offense Reports (DECOR) and can now generate offense/incident reports.
