AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE NEW EQUIPMENT PURCHASE FUND IN THE
AMOUNT OF $167 322.00 TO BE OBTAINED THROUGH THE CITY'S
EQUIPMENT NOTE PROGRAM APPROVED ON FEBRUARY 9 1999 (M&C
G-12462) BY ORDINANCE NO 13701 FOR THE PURPOSE OF FUNDING
TWO 4X4 BRUSH FIRE TRUCKS FROM HOUSTON GALVESTON AREA
COUNCIL FOR THE FIRE DEPARTMENT PROVIDING A SEVERABILITY
CLAUSE MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT
HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2003-
2004 in the Budget of the City Manager there shall also be increased estimated receipts and
appropriations in the New Equipment Purchase Fund in the amount of $167,322 00 to be
obtained through the City's Equipment Note Program approved on February 9 1999 (M&C G-
12462) by Ordinance No 13701 for the purpose of funding two 4X4 Brush Fire Trucks from
Houston Galveston Area Council for the Fire Department.
SECTION 2.
That should any portion, section or part of a section of this severability clause be declared invalid
inoperative or void for any reason by a court of competent jurisdiction such decision opinion or
judgment shall in no way impair the remaining portions, sections or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 15636 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this
ordinance are in direct conflict with such other ordinances and appropriations, in which instance
said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed
SECTION 4
This ordinance shall take effect upon adoption.

Cancellation of Bid and Purchase of Two New 4 x 4 Brush Fire Trucks from the Cooperative
Purchasing Program for the Fire Department
RECOMMENDATION
It is recommended that the City Council:
Authorize the cancellation of Bid No 03-0242 for the purchase of new 4 x 4 brush fire trucks and
2. Authorize the purchase of two new 4 x 4 brush fire trucks from the cooperative purchasing program,
HGAC (Houston Galveston Area Council) Contract No AAA for a cost not to exceed $167 322 with
payment due within 30 days of the date of the invoice and freight is included in the unit price and
3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
New Equipment Purchase Fund by $167 322 to be obtained through the City's Equipment Note program
approved on February 9 1999 (M&C G-12462 Ordinance No 13701)
DISCUSSION
The brush fire trucks are replacements for uneconomically repairable units that will be sold at auction The
trucks will be used by on-duty firefighters to transport personnel and equipment to fight brush and grass
fires in limited off-road access areas and at TMS (Texas Motor Speedway)..
The cancellation of Bid No 03-0242 was requested by staff to make necessary changes to the
specifications by adding and upgrading the following equipment; a front bumper mounted turret nozzle that
includes a monitor electric actuator and automatic drain valve to clear the two inch discharge line joy-stick
controller mounted inside the cab to be used for operating the system without firefighters having to stop or
exit the truck, and the addition of an upgraded class B foaming system that doubles the system s capacity
by including two 10 gallon poly foam storage tanks with an increased flow rate of three gallons per minute at
250 pounds per square inch. The foaming system will be used for the protection of racing fans, drivers and
pit crews at Texas Motor Speedway during races in case of vehicle crashes or fires in the raceway infield
and pit areas.
During the review of the changes needed to the specifications, it was found that the purchase of these
vehicles are available from an HGAC contract with trucks that meet all specifications The Fire Department
has reviewed the pricing from the HGAC contract and finds the cost to be reasonable Under Section
271 102(c) of the Texas Local Government Code a local government purchasing an item under such a
contract satisfies any state law requiring that the local government seek competitive bids for purchase of the
item
M/WBE A waiver of the goal for M/WBE subcontracting requirements was requested by the Purchasing
Division and approved by the M/WBE Office because the purchase of goods is from sources where

subcontracting or supplier opportunities are negligible
