ORDINANCE NO. ` ~(
AN ORDINANCE VACATING AND EXTINGUISHING PORTIONS OF
MISCELLAENOUS STREETS AND ALLEYS AS FOLLOWS A PORTION OF
HARDING STREET BETWEEN BLOCK 159 OF THE ORIGINAL TOWN OF FORT
WORTH AND BLOCK A OF EVANS AND HUFFMAN ADDITION A PORTION OF
PHARR STREET SITUATED ON THE SOUTH SIDE OF BLOCK 159 OF THE
ORIGINAL TOWN OF FORT WORTH, BEING APPROXIMATELY 60 FEET WIDE
AND HAVING A VARIABLE WIDTH OF 68.27 FEET TO 100.10 FEET A PORTION
OF GRANT STREET BETWEEN BLOCKS A AND B OF THE EVANS HUFFMAN
ADDITION AND ALL OF THE 16 FOOT WIDE ALLEY LYING ON THE WEST SIDE
OF BLOCK B OF THE EVANS HUFFMAN ADDITION AND LYING ON THE EAST
SIDE OF THE BOAZ SUMMIT ADDITION AND THE J.L. MOORE SUBDIVISION
PROVIDING FOR REVERSION OF FEE IN SAID LAND• THE RETAINMENT OF
EXISTING UTILITY EASEMENTS, REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1
THAT the following street and alleys described below
1 A portion of Harding Street between Block 159 of the Ongmal Town of Fort Worth,
an unrecorded addition to the City of Fort Worth and Block A of Evans and Huffman
Addition, an addition to the City of Fort Worth, according to the plat thereof recorded
in volume 94 page 368 of the Plat Records of Tarrant County Texas, and containing
approximately 0 603 Acres, (Exhibit A, pages 2 and 3)
2. A portion of Pharr Street situated on the south side of Block 159 of the Ongmal Town
of Fort Worth, an unrecorded addition to the City of Fort Worth, being approximately
60 feet wide and having a variable width of 68.27 feet to 100 10 feet, and containing
approximately 0 115 Acres, (Exhibit A, pages 4 and 5)
3 A portion of Grant Street between Blocks A and B of the Evans Huffinan Addition,
an addition to the City of Fort Worth, according to the plat thereof recorded in volume
94 page 368 of the Plat Records of Tarrant County Texas, contaming~approximately
0.874 Acres; (Exhibit A, pages 6 and 7)
4 All of the 16 foot wide alley lying on the west side of Block B of the Evans Huffman
Addition, an addition to the City of Fort Worth, according to the plat thereof recorded
in volume 94 page 368 of the Plat Records of Tarrant County Texas, and lying on
the east side of the Boaz Summit Addition, an unrecorded addition to the City of Fort

Worth, and on the east side of the J.L. Moore Subdivision, an unrecorded addition to
the City of Fort Worth, containing approximately 0.202 Acres, (Exhibit A, pages 8
and 9) and as more specifically described m Exhibit A attached hereto and
incorporated herein, by reference be and the same are vacated and extinguished.
SECTION 2.
That subject to the conditions m Section 3 all the City's nghts, title and interest m and to
the land in and under the above-described street nghts-of ways and alleys are released and shall
revert to the adjacent owner as provided by law
SECTION 3.
That the vacation, abandonment, closure, and extinguishments of the above described
portion of the streets and alley nghts-of way and the release and reversion of the City's nght,
title, and interest in and to the land therein, shall be subject to and conditioned upon the filing of
a final plat in the Tarrant County Plat Records on or before sixty (60) months from the date of
this Ordinance. In the event such final plat is approved and filed for record in the Tarrant County
Plat Records within the prescribed time, then a copy of said final plat shall be attached as Exhibit
`B" to this ordinance, as same is filed m the office of the City Secretary of the City of Fort Worth
and the attachment of said final plat as `Exhibit `B" shall constitute conclusive evidence of the
occurrence of such conditions. 1n addition, the above-described portion of the streets and alley
nghts-of way shall remain open as public streets and alley nghts of way unless and until the
vacation, abandonment, closure and extinguishment so the become effective upon satisfaction of
the conditions stated above. In the event said plat is not approved by the City and filed in the
Tarrant County Plat Records on or before the date that is sixty (60) months from the date of this
Ordinance, then this ordinance shall become null and void, the same as if it had never been
adopted, the vacation, abandonment, closure, and extmguishments of the street nght-of way and

the release and reversion of the tale and interest m and to the land therein shall not take effect.
SECTION 4.
That all existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 5.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 6.
That this ordinance shall take effect sixty (60) months from the date of this Ordinance, or
upon the acceptance by the City of the replat of the property whichever occurs first. It is the
intent of the City to repeal this ordinance vacating the above-described alley if the replat is not
accepted by the City on or before sixty (60) months from the date of this Ordinance.

Lying on the West Side of Block B of the Evans Huffman Addition and Lying on the East Side of the

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating the following described
portions of alleys and streets.
VA-04-017 Being a portion of Harding Street between Block 159 of the Original Town of Fort Worth an
unrecorded addition to the City of Fort Worth and Block A of Evans and Huffman Addition an addition to the
City of Fort Worth according to the plat thereof recorded in volume 94 page 368 of the Plat Records of
Tarrant County Texas, and containing approximately 0 603 Acres (Exhibit A, pages 2 and 3) and
VA-04-018 Being a portion of Pharr Street situated on the south side of Block 159 of the Original Town of
Fort Worth an unrecorded addition. to the City of Fort Worth being approximately 60 feet wide and having a
variable width of 68 27 feet to 100 10 feet, and containing approximately 0 115 Acres (Exhibit A, pages 4
and 5) and
VA-04-020 Being a portion of Grant Street between Blocks A and B of the Evans Huffman Addition an
addition to the City of Fort Worth according to the plat thereof recorded in volume 94 page 368 of the Plat
Records of Tarrant County Texas containing approximately 0 874 Acres (Exhibit A, pages 6 and 7)• and
VA-04-023 Being all of the 16 foot wide alley lying on the west side of Block B of the Evans Huffman
Addition an addition to the City of Fort Worth according to the plat thereof recorded in volume 94 page
368 of the Plat Records of Tarrant County Texas and lying on the east side of the Boaz Summit Addition

DISCUSSION
Tom Struhs of 511 East Bluff Street, Fort Worth Texas, owner of the adjacent property described above
has requested vacation of said street and alley segments to consolidate property for redevelopment.
Existing improvements include water sanitary sewer electric, telephone gas, cable communications
drainage and roadway paving with curbs and gutters An acceptable re-plat must be received reflecting
appropriate easements to protect the afore described utilities and facilities. A plat note stating that no
