AN ORDINANCE AMENDING ORDINANCE NO 15797 BY
INCREASING THE NUMBER OF DIRECTORS ON THE BOARD
OF DIRECTORS OF TAX INCREMENT REINVESTMENT ZONE
NUMBER NINE, CITY OF FORT WORTH, TEXAS.
WHEREAS, as authorized by Section 311 005(a)(1) of the Texas Tax Code, the
Crty Council created Tax Increment Reinvestment Zone Number Nine, Crty of Fort
Worth, Texas (the `Zone"), which is generally known as the Tnnity River Vision TIF
pursuant to Ordinance No 15797 adopted by the City Council on December 16, 2003
and
WHEREAS, Ordinance No 15797 established a board of directors for the Zone
(the `Board") consisting of eleven (11) members, and
WHEREAS, pursuant to Section 311 009(a) of the Texas Tax Code and in
accordance with Ordinance No 15797 each taxing unit with ~unsdiction in the Zone,
other than the City may appoint one (1) member of the Board and the City Council will
appoint whatever number of members are necessary to fill the remaining positions on the
Board, and
WHEREAS, Section 311 009(x) of the Texas Tax Code provides that the board
of directors of a tax increment reinvestment zone designated pursuant to Section
311 005(a).(1) of the Texas Tax Code may consist of up to fifteen (15) members, and that
the governing body of the mumcipahty that designated the reinvestment zone may
appoint up to ten (10) of those members, and
WHEREAS, the Crty Council wishes to amend Ordinance No 15797 to increase
the number of members on the Board from eleven (11) to fifteen (15}

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF FORT WORTH, TEXAS
Section 1
That Section 3 of Ordinance No 15797 (Zone Board of Directors) is hereby
amended to read as follows.
That a board of directors for the Zone, ("Board") is hereby created. The
Board shall consist of fifteen (15) members who shall serve for terms of
two (2) years each, provided, however that the initial terms of some
members maybe less than two (2) years to allow for subsequent staggered
terms. Of these fifteen (15) members, each taxing unit other than the City
that levies taxes on real property In the Zone may but is not required. to,
appoint one (1) member to the Board. After each taxing unit other than
the City designates to the City either the name of the member that the
taxing unit wishes to appoint or the fact that the taxing unit wishes to
waive rts rlght to appoint a member the Crty Council shall appoint
whatever number of members are necessary to fill the remalmng positions
on the Board. Such members maybe members of the City Council.
Section 2.
That all provisions of Ordinance No 15797 that are not expressly amended herein
shall remain m full force and effect. If any portion, section or part of a section of this
Ordinance is subsequently declared mvahd, inoperative or void for any reason by a court
of competent ~unsdiction, the remaining portions, sections or parts of sections of this
Ordinance shall be and remain in foil force and effect and shall not in any way be
impaired or affected by such decision, opinion or~udgment.

Section 3.
That this Ordinance shall take effect and be m full force and effect from and after
its adoption.

Ordinance Amending the Number of Members Appointed to the Board of Directors for Tax
Increment Reinvestment Zone Number Nine City of Fort Worth Texas
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance which amends the number of
members appointed to the Board of Directors of Tax Increment Reinvestment Zone Number Nine City of
Fort Worth Texas.
DISCUSSION
On December 16 2003 the City Council approved Ordinance No 15797 designating Tax Increment
Reinvestment Zone Number Nine City of Fort Worth Texas being referred to as the Trinity River Vision
TIF (the TIF) The ordinance also established the size of the Board of Directors of the TIF (the Board) at 11
members with one appointment from each of the five taxing entities other than the City with jurisdiction in
the TIF and six appointments from the City
In order for the Board size to adequately reflect the participation of the other taxing entities Staff believes
the size of the Board for the Trinity River Vision TIF should be changed from 11 to 15 which will consist of
one appointment from each of the five taxing entities and ten appointments from the City
