HomeMy WebLinkAboutOrdinance 18956-12-2009Grdinance No.~18956-12-2009 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPRGPRIATIGNS IN THE AMERICAN REINVESTMENT RECQVERY ACT ~ARRA~ 2009 SFR RELAIM WATER FUND IN THE AMGUNT 4F $16,265,000.00, FROM AVAILABLE FUNDS FOR THE PURPGSE 4F PROVIDING FUNDING FGR RECLAIM WATER INFRASTRUCTURE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIQR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY QF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2009- 2010and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the American Reinvestment Recovery Act ~ARRA~ 2099 SFR Reclaim Water fund in the amount of $16,265,000.00, from available funds for the purpose of providing funding for the reclaim water infrastructure. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.18809 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: 4n November 9, 2004, the City Council approved Resolution No. 3131 requesting f nancial assistance from the Texas Water Development Board ~TWDB} for a Regional Facility Planning Grant to develop the Fort Worth Water Reuse Priority and Implementation Plan, ~n May 10, 2005, the City Council approved City Secretary Contract No. 31841 ~M&C C-20121 }with Alan Plummer Associates, Inc., ~APAI} to design the Eastside Reclaim water system and to assist with development of wholesale reclaimed water contracts for service to the Cities of Arlington and Euless and the DFW international Airport. On August 11, 2009 (Resolution No. 3773) the City Council authorized the filing of a Federal Stimulus Loan/Grant application with the Texas Water Development Board through the Texas Commission on Environmental Quality. Resolution No. 3773 applied fora $22,620,000.00 loan/grant under the Drinking Water State Revolving Fund-American Recovery and Reinvestment Act of 2009 (DWSRF/ARRA) Fund to finance water system improvements including the construction of a 14 million gallon per day reclaimed water pump station at the Village Creek Wastewater Treatment Plant and 57,000 linear feet of 36 inch to 16 inch reclaimed water transmission mains. The application amount was decreased to $16,265,000.00 based on actual bids received for the four construction projects. These funds came from the Texas Water Development Board using the Federal ARRA Special Capitalization Grant in lieu of TWDB Water and Sewer Subordinate Lien Revenue Bonds. As part of this Federal funding, financing loan carries a 0 percent interest rate and requires no Texas Water Development Bond origination fees (normally 2.25 percent of total loan) which will require annual principal repayments with no interest payments. This project is located in CGUNCIL DISTRICT 5.
