AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS
IN TIIE LAKE WORTH TRUST FUND, LAKE WORTH LEASES UNSPECIFIED IN
THE AMOUNT OF $113,161 FROM AVAILABLE FUNDS FOR THE PURPOSE OF
FUNDING A REIMBURSEMENT TO JERRY AND JOANN SWANSON FOR
IMPROVEMENTS LOCATED ON LOT 9C, BLOCK 8, LAKE WORTH LEASE
SURVEY, MAKING THIS ORDINANCE CUMULATNE OF PRIOR ORDINANCES
IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTNE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2001-02 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Lake
Worth Trust Fund, Lake Worth Leases Unspecified in the amount of $113,161 for the purpose funding a
reunbursement to Jerry and Joann Swanson for improvements located on Lot 9C, Block 8, Lake Worth Lease
Survey
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No. 14745 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are m direct conflict with
such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

MARINA DRIVE, LAKE WORTH LEASE SURVEY, CITY OF FORT WORTH, TARRANT
COUNTY, TEXAS, TO JERRY AND JOANN SWANSON
RECOMMENDATION
It is recommended that the City Council
Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by
$113,161 00 in the Lake Worth Trust Fund, Lake Worth Leases Unspecified, from available funds,
and
2 Authorize the transfer of $113,161 00 from the Lake Worth Trust Fund, Lake Worth Leases Unspecified,
to the Lake Worth Trust Fund, Lease Reclamation, and
3 Approve the sale of Lots 9A and 96, Block 8, Lake Worth Lease Survey to Jerry and Joann
Swanson, and
4 Approve reimbursement to Jerry and Joann Swanson for improvements located on Lot 9C, Block 8,
Lake Worth Lease Survey; and
5 Authorize the City Manager to execute the appropriate documents to complete the sale
DISCUSSION
On June 28, 1971, the City of Fort Worth entered into a 25-year lease with Mr Worth Boggeman for the
lease of Lots 9A, 9B and 9C, Block 8, Lake Worth Lease Survey, herein after referred to as "total
property" The lease was transferred to All Seasons Yachts, Inc. (Kathleen Souders, President) in April
1991, and subsequently transferred to Jerry and Joann Swanson when they purchased All Seasons
Yachts, Inc. in 1992
Mr and Mrs Swanson have continuously operated a marina facility and lakeside cafe since they
purchased the business and total property Improvements on the total .property consist of a marina
facility including boat slips, a boat launch ramp and dock, a warehouse facility for boat repairs, a fishing
barge, a full service restaurant, and a three bedroom, 3,000 square foot, private residence
The original lease expired in May 1996, however, Mr and Mrs Swanson have continued to lease this
property on a month-to-month basis
Mr and Mrs Swanson now desire to terminate their month-to-month lease, and be reimbursed for the
improvements on Lot 9C, according to the terms of the original lease agreement. Paragraph 11 of the
original lease agreement states " City shall pay to Lessee an amount equal to the then market value
of any structures or improvements heretofore made or erected on the demised premises "

The improvements on Lot 9C for which the Swanson's are eligible for reimbursement are
• A metal shop building used for boat service and dry dock storage The building contains
approximately 32,500 square feet; and
• A full service sit down restaurant that seats approximately 35 people and is approximately 1,556
square feet in size, and
• A 2,329 square foot fishing barge built over the water; and
• A dock house consisting of 1,200 square feet; and
• Ninety-one covered boat slips, and
• Paving and fencing on the property
The total value of the improvements on Lot 9C for which the Swanson's are eligible for reimbursement
is $173,325 00
The Swanson's will purchase Lots 9A and 96, which are the two residential zoned lots improved with
their homestead The value of Lots 9A and 9B is $27,300 00
Total property and improvement value was determined by an independent, outside appraiser
It is recommended that following approval of this transaction, the improvements located on Lot 9C be
demolished The property is located adjacent to an existing park, and the City of Lake Worth has
expressed the desire to lease the land for park expansion The demolition of the improvements will
ensure that the property is no longer used as a commercial marina, and it will not be necessary to
install water and/or sewer service to this site.
The demolition of the improvements on the total property is estimated to cost $132,800 00 and is based
on a demolition contractor proposal The demolition cost has been prorated so the Swanson's are
responsible for their share of the demolition, costs for any structures or improvements that lie on Lots
9A or 9B The Swanson's will pay approximately $32,864 00 for the demolition, of improvements on
Lots 9A and 9B, and the City will pay approximately $99,936 00 for the demolition of improvements on
Lot 9C

Sale of Lots 9A and 9B to Mr and Mrs. Swanson (Land Sales Price) ($ 27,300 00)
Deduct for demolition of commercial improvement on Lots 9A and 9B ($ 32,864.00)
Net total improvement compensation to Mr and Mrs Swanson $113,161 00
The Swanson's have agreed that upon approval of this purchase of improvements and sale of land they
will no longer operate any type of marina or commercial facility on Lots 9A and 9B This property is
zoned for residential purposes only Lot 9C will be cleared of improvements and will be fenced and
secured
These properties are located in COUNCIL DISTRICT 7, Mapsco 45V
FISCAL INFORMATION/CERTIFICATION
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated,
of the Lake Worth Trust Fund
