HOWARD ADDITION TO THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That a 30 feet wide by 175 feet long drainage and utility easement containing approximately 5,250 square feet, located on Danner Street and situated between Lot 11, Block 2, and Lot 20, Block 3, W R Howard Addition in Fort Worth, and as recorded in Volume 204-A, Page 153, Plat Records, Tarrant County, and as more specifically described in Exhibit A, attached hereto and incorporated herein by reference, be and the same is vacated and extinguished SECTION 2 That the fee to the land in the above described vacated utility and drainage easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4 That this ordinance shall take effect upon adoption ~,. ._ ~. HOWARD ADDITION, FORT WORTH, TEXAS (VA-02-051) RECOMMENDATION It is recommended that the City Council adopt the attached ordinance vacating a 30-foot wide by 175- foot long drainage and utility easement between Lot 11, Block 2 and Lot 20, Block 3, W R. Howard Addition, as recorded in Volume 204-A, Page 153, Plat Records, Tarrant County, Texas, containing 5,250 square feet between the 2000 and 2100 block of Danner Street. DISCUSSION J Ossie M Brooks and Harold Weathersby, owners of the above described property, have requested vacation of the referenced drainage and utility easement to expand the building area. The easement was retained following vacation of the previous street known as Burns Street. There are no known utilities in this easement. The Engineering Department, Real Property Services Division states that a fee of $1 00 will satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request. An acceptable replat has been provided (FS-02-107) This easement is located in COUNCIL DISTRICT 5 FISCAL INFORMATION/CERTIFICATION• The Finance Director certifies that this action will have no material effect on City funds.
