J , Ordinance No ~~/ AN ORDINANCE INCREASING APPROPRIATIONS IN THE FEDERAL AWARDED ASSETS FUND IN THE AMOUNT OF $1 467 AND DECREASING THE UNDESIGNATED, UNRESERVED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF FUNDING THE CITY'S CASH MATCH OF A CONTRACT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION (TXDOT) FOR THE CONTINUED OPERATION OF THE WAVE SELECTIVE TRAFFIC ENFORCEMENT PROGRAM (STEP); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 2002-2003 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Federal Awarded Assets Fund in the amount of $1,467 and decreasing the Undesignated, Unreserved Fund balance by the same amount, for the purpose of funding the City's cash match of a contract with the Texas Department of Transportation (TX DOT) for the continued operation of the Wave Comprehensive Selective Traffic Enforcement Program (STEP). SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption. '~l ~ ~' City of Fort Worth, Texas ~Ilaya~ ~d Cat~NCjB Ca~w~waNica~jaN DATE REFERENCE NUMBER LOG NAME PAGE 10/29/02 **C-19322 35WAVE 1 of 3 SUBJECT WAVE STEP (SELECTIVE TRAFFIC ENFORCEMENT PROGRAM) RECOMMENDATION It is recommended that the City Council Authorize the City Manager to accept the contract with the Texas Department of Transportation (TxDOT) to continue to operate the Wave STEP (Selective Traffic Enforcement Program) from November 15, 2002, through September 30, 2003, on an overtime basis in the amount of $14,467 (state $13,000, City $1,467), and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $14,467, and 3 Adopt the attached appropriation ordinance increasing appropriations in the Federal Awarded Assets Fund by $1,467 and decreasing the undesignated, unreserved fund balance by the same amount; and 4 Authorize the transfer of $1,467 from the Federal Awarded Assets Fund to the Grants Fund for the City's cash match, and 5 Authorize the City Manager to waive the indirect cost in the amount of $2,143, since indirect costs are not allowed by TxDOT DISCUSSION The purpose of this program is to conduct additional occupant protection and speed enforcement during selected holiday periods Traffic officers will conduct pre and post surveys of safety belt usage and speed compliance, will incorporate pre and post public information and education efforts, and will increase enforcement during the designated holidays Results of special statewide demonstration STEPs conducted in Texas and five other states affirm that coordinated waves of enforcement, surveys, and public information and education are feasible, manageable, and highly effective in reducing traffic-related fatalities, injuries, and costs Reports from these demonstration STEPs show significant increases in safety belt use rates, high-level law enforcement participation, and extensive publicity generated from both state and community program activity Seasonal problems are evident in traffic with safety belts and/or speeding These trends can be addressed by focusing on the key issues of safety during peak times such as speed and seat belt enforcement during certain holiday periods According to the National Safety Council, people wearing safety belts have a 45% better chance of surviving a serious traffic crash, and a 50% better chance of surviving without severe injuries ~' z City of Fort Worth, Texas or ~d eoaMCiB CoiwrwrwieuEfoN DATE REFERENCE NUMBER LOG NAME PAGE 10/29/02 **C-19322 35WAVE 2 of 3 SUBJECT WAVE STEP (SELECTIVE TRAFFIC ENFORCEMENT PROGRAMI The State of Texas has had a Mandatory Use Law (MUL) for safety belts since 1985 Since that time, Texas has seen safety belt use rise to among the highest levels in the country In 2002, according to the Texas Transportation Institute (TTI), Texas A&M University, the statewide safety belt usage rate for Texas is 81 1 The child passenger restraint law was implemented in 1984 for infants and children from birth to 4 years of age to protect them while riding in a car or light truck.
