Ordinance No ~~~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $217,093 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH CARTER & BURGESS, INC , FOR SANITARY SEWER REHABILITATION CONTRACT LXVIII (68); MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2002- 2003 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $217,093 for the purpose funding an engineering agreement with Carter & Burgess, Inc. for Sanitary Sewer Rehabilitation Contract LXVIII (68). SECTION 2 That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 15184 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed SECTION 4 This ordinance shall take effect upon adoption APPROVED AS 7, O FORM AND LEGALITY Assistant City Attorney ADOPTED AND EFFECTIVE. ~ I f ~~l ~~ ,..~ City of FoYt Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 11/12/02 **C-19346 30SPECIF 1 of 2 SUBJECT APPROPRIATION ORDINANCE AND ENGINEERING AGREEMENT WITH CARTER & BURGESS, INC FOR SANITARY SEWER REHABILITATION CONTRACT LXVIII (681 RECOMMENDATION It is recommended that the City Council 1 Authorize the transfer of $217,093 from the Water and Sewer Operating Fund to the Sewer Capital Project Fund, and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Project Fund in the amount of $217,093 from available funds, and 3 Authorize the City Manager to execute an engineering agreement with Carter & Burgess, Inc in the amount of $207,093 for Sanitary Sewer Replacement Contract LXVIII (68) DISCUSSION This project consists primarily of the preparation of plans and specifications for the rehabilitation of the following severely deteriorated sanitary sewer mains and laterals • M-154/L-2509/L-2499 Located in an area that is generally bound on the north by Donnelly Avenue, on the south by Diaz Avenue, on the east by Neville Street and on the west by Eldridge Street; and • L-3132 Beginning from the Old Benbrook Road/Mary's Creek Road intersection, northerly along Old Benbrook Road to Davenport Avenue, and • L-2790/L-2789 Located in an area that is generally bound on the north, east and west by Rockwood Park Drive and on the south by Lakewood Drive, and • L-4143 Located in the alley between Humbert Drive and Farnsworth Drive from Bourine Street to Prevost Street; and • L-4565 Located in the alley between Helmick Drive and Carver Drive from Faron Street to Prevost Street; and • L-3586 Located in the alley between Fernander Drive and Como Drive from Faron Street to Bourine Street; and • L-2781 Beginning from 600 feet west of Wildwood Drive/Eastwood Avenue intersection, easterly 400 feet, then southerly 2,300 feet along the west property line of Greenwood Cemetery, then westerly 300 feet; and City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 11/12/02 **C-19346 30SPECIF 2 of 2 SUBJECT APPROPRIATION ORDINANCE AND ENGINEERING AGREEMENT WITH CARTER & BURGESS, INC FOR SANITARY SEWER REHABILITATION CONTRACT LXVIII (68) • L-2140 Located in the alley between Pershing Avenue and Birchman Avenue from Halloran Street to Bourine Street Carter & Burgess, Inc proposes to perform the design work for a lump sum fee of $207,093 City staff considers this fee to be fair and reasonable for the scope of services proposed M/WBE -Carter & Burgess, Inc. is in compliance with the City's M/WBE Ordinance by committing to 32% M/V1/BE participation The City's goal on this project is 24% The project is located in COUNCIL DISTRICTS 3 and 7, Mapsco 61 R and V, 73V and Z, 74H, K, L, M, X, Y and V, 75P and S, and 87D In addition to the contract amount, $10,000 is required for project management by the Engineering Department.
