ORDINANCE NO N ~ ` AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $132,791 16 FROM AVAILABLE FUNDS FOR THE PURPOSE OF AN ADVANCE FUNDING AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FORA 24- INCH WATER MAIN CONNECTION AT FM157 AND PIPELINE ROAD, PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION I That m addition to those amounts allocated to the various Crty departments for Fiscal Year 2001/02 m the Budget of the Crty Manager, there shall also be increased estimated receipts and appropriations m the Water Capital Project Fund m the amount of $132,791 16 from available funds for the purpose of an advance funding agreement with the Texas Department of Transportation fora 24-inch water main connection at FM157 and Pipeline Road. SECTION 2 Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall m,no way impair the remaining portions,- sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain m full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No 14745 and all other ordinances and appropriations amending the same except m those instances where the provisions of this ordinance are m direct conflict with such other ordinances and appropriations, mwhich instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $132,791 16 from available funds, and 3 Authorize the City Manager to execute an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) providing for the connection of a proposed 24-inch water main to an existing water main at FM157 and Pipeline Road for a total cost of $132,791 16 DISCUSSION On February 20, 2001 (M&C C-18466), the City Council authorized a contract with B&H Utilities, Inc. in the amount of $1,039,317 00 for the construction of a 24-inch water main relocation in FM157 and a 16- inch water main extension in Trinity Boulevard This contract was required to relocate the City's facilities ahead of the pending TxDOT reconstruction of FM157 Construction is substantially complete with the exception of the connection of a 24-inch water main to an existing main in Pipeline Road The connection of this main is critical and difficult due to the traffic on FM157 City staff examined options with B&H Utilities, Inc. and TxDOT to provide the most efficient means of completing this work and minimizing potential conflicts It was decided, with concurrence from B&H Utilities, Inc., to delete the remaining work in its contract and accomplish it through a change order to the TxDOT's contractor for FM157, Ed Bell Construction City staff is currently preparing a deduction change order to the original B&H Utilities, Inc. contract (City Secretary Contract No 26584) which will also include the assessment of liquidated damages to the contractor for failing to complete the work in a timely manner Ed Bell Construction has overall traffic control responsibility for the project and will include this work with other utility work it is performing in FM157 The actual construction cost is $119,524 00 The amount of $13,267 16 is included in the $132,791 16 amount for TxDOT engineering overhead and contingencies This project is located in COUNCIL DISTRICTS 5 and 6, Mapsco 55T and X. .4+ '``.
