HomeMy WebLinkAboutOrdinance 1523109-12-~2 A 1 1 42 I ?d /`~~ Ordinance No. AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL ASSESSMENT DISTRICT FUND IIV THE AMOUNT OF $34,035 FROM AVAILABLE FUNDS FOR THE PURPOSE OF PROVIDING FISCAL YEAR 2002-2003 FUNDING FOR IlVIPROVEMENT DISTRICT NO. 10; PROVIDING FOR A SEVERABILTI'Y CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE TT ORDAINED BY THE CITY COUNCII. OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amownts allocated to the various City deparwents for the Fiscal Year 2002-2003 and in the Budget of the City 1Vlanager, there shall also be increased estimated receipts and appropriations in the Speciai Assessment District Fund in the amount of $34,035 00 from available funds for the purpose of providing fiscal year 2002-2003 funding for Improvement District No. 10. SECTION 2. Should any portion, section or part of a section of this ordinance be declares invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 14836, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are indirect conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY. DISCUSSION On August 27, 2002 (M&C G-13711), the City Council approved certain improvements and/or services to be provided in Fort Worth PID No 10 during .FY2002-2003 The City Council also adopted the proposed assessment roll and authorized notice of this benefit hearing The improvements to be° provided and the costs are as follows Total Cost Assessment Maintenance and Landscaping Program $93,750 $34,035 Management Program $ 2,000 -0' TOTAL $95,750 $34,035"' *The $61,715 difference between total costs and assessments includes $1,040 in direct payments from the City, which was appropriated from the General Fund balance by City Council action on August 27, 2002 (M&C G-13711), $53,176 in revenues from other special improvement district activities generated from PID No 1, and $7,499 from "The T" for contract services All costs of improvements shall be assessed against private property located in the District and the owners of the property The City Manager has filed with the City Secretary's Office a proposed assessment roll and an estimate of the assessments against each parcel Based on the appraised value of the property, and considering the benefits to be received from the proposed improvements, it is the opinion of City staff that each parcel of property will be enhanced in value by an amount equal to or more than the proposed assessments upon completion of the improvements in accordance with the contract. =.~ ~, City of Fort Worth, Texas Manor and Council Communication
