HomeMy WebLinkAboutOrdinance 153311 1 -1 4-02 A 1 1 20 I N ORDINANCE NO. ° ~J AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY OF FORT WORTH, ESTABLISHING A NEW ONE-FAMILY RESIDENTIAL ZONING DISTRICT WITH MINIMUM LOT SIZE OF 108,900 SQUARE FEET (2.5 ACRES); ESTABLISHING LOT WIDTH, LOT COVERAGE, SETBACK AND HEIGHT REQUIREMENTS; ESTABLISHING OTHER DEVELOPMENT STANDARDS; RENUMBERING SECTIONS 4.700 THROUGH 4.710 OF ARTICLE 7, "RESIDENTIAL DISTRICTS," AMENDING THE RESIDENTIAL USE TABLE TO REFLECT USES ALLOWED IN "A-2.5A" ONE-FAMILY DISTRICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the zoning ordinance of the City of Fort Worth currently provides for five one- family zoning districts. the "A-5" One-Family District requiring. a minimum lot size of 5,000 square feet; the "A-7.5" One-Family District requiring a rninimum lot size of 7,500 square feet; the "A-10" One-Family District requiring a minimum lot size of 10,000 square feet; the "A-21" One-Family District requiring a minimum lot size of one-half acre, and the "A-43" One-Family District requiring a minimum lot size of one acre, WHEREAS, areas considered by the City for annexation have existing single-family developments on lots larger than one acre, WHEREAS, residents and owners of property in these areas have expressed a desire to maintain the large lot character of their developments, WHEREAS, although the City affirms its commitment to affordable housing and recognizes the need for the continued availability of small lot residential zoning, experience has shown that larger lot sizes are appropriate in certain situations to promote the public health, safety, morals or general welfare by, among other things, providing for different street standards, ensuring compatibility with adjacent uses, and maintaining compatible lot sizes in developed areas, WHEREAS, the City Council in adopting this ordinance affirms its intent that the ordinance not be applied involuntarily to existing zoned properties absent compelling circumstances, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Chapter 4, Article 7 of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, "Residential Distracts", is hereby amended by renaming Section 4 700, "One-Family ("A- 43") District" to "One-Family ("A-2.SA") District" and to renumber the current sections of Chapter 4, Article 7 as outlined in Section 2 of this amendment, in order to provide for one-family lots with a minimum size of two and one-half acres (108,900 square feet), as follows. A. Purpose and Intent It is the purpose and intent of the One-Family ("A-2.SA") Distract to provide a zone with a minimum lot size of two and one-half acres for rural-style development of a one-family dwelling on each lot and accessory uses. The minimum lot size of two and one-half acres may also be appropriate to maintain compatible lot sizes m developed areas, ensure compatibility with adjacent uses, or otherwise promote 'the public health, safety, morals or general welfare. B. Uses In the One-Family ("A-2.SA") District, no building or land shall be used and no building shall be hereafter erected, reconstructed, altered or enlarged, nor shall a Certificate of Occupancy be issued, except in accordance with the use tables in Chapter 4, Articles 6 and 8, and the supplemental standards of Chapter 5 2 C. Property Development Standards In the One-Family ("A-2.SA") District, the minimum dimension of lots and yards and the height of buildings shall be as follows. Lot Area. Two and one=half acres (108,900 square feet) minimum (Sections 6.501 and 7 106) Lot Width. 150 feet minimum at building line Lot Coverage: 20°Io maximum Front Yard.* 35 feet minimum Rear Yard. 25 feet minimum Side Yard.* Interior lot: 25 feet minimum Corner lot.** 35 feet minimum adjacent to side street and 25 feet minimum for interior lot line Height: 35 feet maximum (See Section 6 100) *May be subject to setback averaging (Section 6 lO1D) **May be subject to projected front yard (Section 6.1O1F) D. Other Development Standards Development in the One-Family ("A-2.SA") District may be subject to a variety of general development standards in Chapter 6, and the following provisions. 1 Signs. On-premises signs subject to the following: a. An unilluminated nameplate beanng the family name of the occupants residing in the residence not to exceed one square in foot area. b An unilluminated sign for those uses allowed that are not residential The sign shall not exceed 30 square feet in area, shall be no higher than six feet above grade, and shall be placed a minimum of ten feet behind the property line. Such sign shall not be placed within 20 feet of drives providing ingress and egress to the property 2. Parking. Two spaces per dwelling unit, located behind the front building line. For nonresidential uses, see Chapter 6, Article 2. 3 Residential Design Standards. See Chapter 6, Article 5 4 Landscaping and Buffers. Nonresidential uses may require landscaping or buffers. See Chapter 6, Article 3 3 5 Access through Residential Districts. See Section 6.500 Commentary concerning carports and fences set out in Section 4 705, One-Family ("A-5") District, shall apply to development in the One-Family ("A-2.SA") District. SECTION 2. Chapter 4, Article 7, "Residential Districts" of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, Sections 4 700 through 4 710 are hereby renumbered and renamed as follows 4 700 One-Family ("A-2.SA") District 4 701 One-Family ("A-43") District 4 702 One-Family ("A-21") District 4 703 One-Family ("A-10") District 4 704 One-Family ("A-7.5") District 4 705 One-Family ("A-5") Distract 4 706 One-Family Restricted ("AR") District 4 707 Two-Fairuly ("B") District 4 708 Zero Lot line/Cluster ("R1") District 4 709 Townhouse/Cluster ("R-2") District 4 710 Low Density Multifamily ("CR") District 4 711 Medium Density Multifamily ("C") District 4 712 High Density Multifamily (D") Distract SECTION 3. Chapter 4, "Distract Regulations," Article 1, "General," Section 4 100B "Districts Established," Residential Distracts" of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, is hereby amended as follows. B. Residential Districts 1 4 700 One-Family ("A-2.SA") District 2. 4 701 One-Family ("A-43") Distract 3 4 702 One-Family ("A-21") District 4 4 703 One-Family ("A-10") District 5 4 704 One-Family ("A-7.5") District 6 4 705 One-Family ("A-5") District 7 4 706 One-Family Restricted ("AR") District 8 4 707 Two-Family Restricted ("B") District 9 4 708 Zero Lot lme/Cluster ("R1") District 4 10 4 709 Townhouse/Cluster ("R-2") District 11 4 710 Low Density Multifamuly ("CR") Distract 12. 4 711 Medium Density Multifairuly ("C") District 13 4 712. High Density Multifamily (D") Distract SECTION 4. Chapter 4, Article 6 of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, Section 4 603, "Residential District Use Table", is amended to add a column reflecting the uses permitted in the "A-2.SA" One-Family District, which shall be the same uses permitted in the "A-5," "A-7.5," "A-10," "A-21," and "A-43°' One-Family Districts. SECTION 5. Chapter 9 of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, "Definitions", is amended by amending the definition of "One- and Two-Family Districts" to include the "A-2.SA" One-Family Distract, as follows. ONE- AND TWO-FAMILY DISTRICTS: Collectively, the "A-2.SA", "A-43", "A-21", "A-10", "A-7.5", "A-5", "AR", "B", "R1" and "R2" Districts. SECTION 6. Any reference in the zoning ordinance to the "A" One-Family District is hereby deemed to include the "A-2.SA" One-Family Distract, except where such construction would be clearly inconsistent with the intent of the ordinance. SECTION 7. Except as expressly amended, all provisions of the Ordinance No 13896, as amended, shall remain in full force and effect. 5 SECTION 8. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 9. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 10. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 11. All nghts and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 3011, Ordinance No. 13896, or any other 6 ordinances affecting zoning which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 12. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government Code. SECTION 13.
