ORDINANCE NO. /~' AN ORDINANCE VACATING AND EXTINGUISHING A 520-FOOT LONG VARIABLE WIDTH ALLEY LOCATED IN BLOCK 1, VICKERY PLACE ADDITION, AND LOTS 1 THROUGH 10, BLOCK 13, HARLEM HILLS ADDITION, FORT WORTH, TARRANT COUNTY, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a 520-foot long variable width alley, consisting of a 0.227 acre tract of land, located in Block 1, Vickery Place Addition, and Lots 1 through 10, Block 13, Harlem Hills Addition, as recorded in Volume 388-6, Page 122, Plat Records, Tarrant County, Texas, and as more specifically described in Exhibit A, attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described vacated alley is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. The bearings for this description are based on the north line of Block 1, Vickery Place, Recorded in Volume 388-165, Page 41, Plat Records, Tarrant County, Texas. Said 0.227 acre tract being described by metes and bounds as follows Beginning at a'/2" iron rod found at the northwest corner of the said Block 1, Vickery Place Addition, and being the intersection of south right of way line of the said 20' Alley and the east right of way line of Prevost Street, a 60' public right of way as shown on the said Final Plat of Harlem Hills Addition, THENCE North 0°02'10" West, along the said east right of way line of Prevost Street, a distance of 20 07 Feet to a'/2" iron rod found at the southwest corner of Lot 1 of said Block 13, Harlem Hills Addition , THENCE South 89°43'51" East, along the north line of the said alley, a distance of 520 03 Feet to the southeast corner of Lot 10 of said Block 13 and the intersection of the north right of way line of the said alley and the west right of way line of Merrick Street, a 60' public right of way; THENCE South 0°03'02" East, along the said west right of way line of Merrick Street, a distance of 17 93 Feet to a P.K. WILLIANiS •.•~ •••.e.••m•....... ,.•., City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 6/18/02 **PZ-2390 06VA-002-019 1 of 1 SUBJECT ADOPT AN ORDINANCE VACATING AN ALLEY LOCATED IN BLOCK 1, VICKERY PLACE ADDITION, AND LOTS 1 THROUGH 10, BLOCK 13, HARLEM HILLS ADDITION, FORT WORTH, TEXAS (VA-002-019) RECOMMENDATION It is recommended that the City Council adopt the attached ordinance vacating a 520-foot long variable width alley, consisting of a 0 227 acre tract of land, located in Block 1, Vickery Place Addition, and Lots 1 through 10, Block 13, Harlem Hills Addition, as recorded in Volume 388-6, Page 122, Plat Records, Tarrant County, Texas - DISCUSSION Vic Tinsley Partners, owner of the above described properties, has requested vacation of the referenced alley to replat with adjoining land for future developments Any relocation of Texas Utilities facilities will be at the developer's expense The City Plan Commission recommended approval at it's public hearing on March 27, 2002. The Engineering Department, Real Property Services Division has determined that $918 84 is a reasonable price for said alley, and has received payment. Reviewing City departments and public utility companies have raised no objections to this request.
