AMOUNT OF $234,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF PROVIDING FISCAL YEAR 2002-2003 FUNDING FOR IlVIPROVEMENT DISTRICT NO. 8; PROVIDING FOR A SEVERABILTTY CLAUSE; MAIIONNG THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That in addition to those amounts allocated to the various City departments for the Fiscal Year 2002-2003 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Assessment District Fund in the amount of $234,000.00 from available funds for the purse of funding the public improvements and services for Fort Worth Public Improvement District No. 8. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in ~ full force and effect. SECTION 3. That this ordinance shall be cumulative to Ordinance No. 14821 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVE TO FORM AND LEGALITY: ~~ Assistan~City Attorney ` ~11~~~~ Date 11D eZ 1 Adopted ~ ,~~a ~ Effective City of FoYt WoYth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 9/10/02 BH-207 13BH8 1 of 2 SUBJECT BENEFIT HEARING FOR FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO 8 (CAMP BOWIE), ADOPTION OF APPROPRIATION ORDINANCE AND LEVYING OF ASSESSMENTS FOR FISCAL YEAR 2002-2003 RECOMMENDATION It is recommended that the City Council 1 Hold a benefit hearing on September 10, 2002, concerning the proposed property assessments of Fort Worth Public Improvements District (PID) No 8 (Camp Bowie) for FY2002-2003, and 2 Close the benefit hearing, and 3 Adopt the attached ordinance which levies the proposed assessments, and 4 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations by $234,000 in the Special Assessment District Fund from available funds DISCUSSION On August 27, 2002 (M&C G-13714), the City Council adopted certain improvements and/or services to be provided in Fort Worth PID No 8 during FY2002-2003 The City Council also adopted the proposed assessment roll and provided notice of this benefit hearing The improvements to be provided and the costs are as follows , Total Cost Assessment • City administration $ 2,600 $ 2,600 • Capital improvements $ 95,000 $ 95,000 • Design guidelines $ 11,400 $ 11,400 • Marketing campaign $ 20,000 $ 20,000 • Special events $ 15,000 $ 15,000 • Operations 90 000 9$ 0,000 Totals $234,000 $234,000* *Total costs for improvements and service in the district are to be paid wholly from assessments with no reimbursement from the City of Fort Worth All costs of improvements shall be assessed against private property located in the District and the owners of the property The City Manager has filed with the City Secretary's Office a proposed assessment roll and an estimate of the assessments against each parcel City of Fort Worth, Texas Mayor and Council Communication DATE 9/10/02 REFERENCE NUMBER gH_207 LOG NAME 13BH8 PAGE 2 of 2 SUBJECT BENEFIT HEARING 'FOR FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO 8 (CAMP BOWIE), ADOPTION OF APPROPRIATION ORDINANCE AND LEVYING OF ASSESSMENTS FOR FISCAL YEAR 2002-2003 Based on the appraised value of the property, and considering the benefits to be received from the proposed improvements, it is the opinion of City staff that each parcel of property will be enhanced in value by an amount equal to or more than the proposed assessments upon completion of the improvements in accordance with the PID No 8 management contract between the City and Historic Camp Bowie, Inc.
