HomeMy WebLinkAboutOrdinance 15042 ORDINANCE NO. ~~ AN ORDINANCE VACATING AND EXTINGUISHING A SEGMENT OF 34T" STREET, LOTS 11 THROUGH 15, BLOCK 1, AND LOTS 1 THROUGH 5, BLOCK 2, LOCATED IN THE SYLVANIA INDUSTRIAL DISTRICT, FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HERE-WITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 THAT a 60-foot wide segment of 34"' Street, extending west of Bethlehem Avenue approximately 440 feet to 480 feet and situated in Lots 11 through 15, Block 1, and Lots 1 through 5, Block 2, Sylvania Industrial District, Fort Worth, Texas, containing approximately 27,333 square feet, and as recorded in Volume 388-20, Page 5, Deed Records, Tarrant County, Texas and as more specifically described in Exhibit A, attached hereto and incorporated herein by reference be and the same is vacated and extinguished SECTION 2. That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owner as provided by law SECTION 3 That ail ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. DISCUSSION Sam Shmaisani, Colleyville, Texas, owner of the above affected property, has requested vacation of the street right-of-way to consolidate the site for a concrete batch plant. No paving or City utilities are within the right-of-way, and an electric utility easement shall be retained The right-of-way was originally obtained by plat dedication The City Plan Commission recommended approval at its Public Hearing on November 22, 2000 The Engineering Department, Real Property Services Division states that an acquisition fee of $11,167 80 has been received to satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request.
