HomeMy WebLinkAboutOrdinance 15142r .~ ORDINANCE NO ~~,~ ~~ AN ORDINANCE AMENDING RESIDENTIAL GARBAGE COLLECTION FEES IN ACCORDINACE WITH SECTION 12.5-842 OF THE CITY CODE, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A SAVINGS CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Sec. 12 5-842 of the City Code (the Code) provides that the City Council shall by ordinance set rates for solid waste collection services, and WHEREAS, the Code provides that the Environmental Management Director shall charge customers rates pursuant to such schedules, NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT SECTION 1 The following residential garbage collection fees are adopted as provided for in Section 12.5-842 of the Code of the City of Fort Worth, Texas (1986), as amended SERVICE MONTHLY RATE Residential Curbside $13 75 Elective Carryout $33.50 SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section SECTION 4. Adopt the attached ordinance approving the following rate increase as provided for in Section 12.5-842, of the City Code, and SERVICE CURRENT RATE PROPOSED RATE Residential Curbside Elective Carryout $12.50 $32.25 $13 75 $33 50 3 Adopt the attached appropriation ordinances increasing estimate receipts and appropriations up to $562,279 00 in the Solid Waste Management Fund for FY2001-2002. BACKGROUND On October 1, 1982, the Solid Waste Enterprise Fund was established and all solid waste management operations are totally funded through service fees established for garbage collection and waste disposal Over the last five years, the Solid Waste Enterprise Fund fees have been changed as follows DATE FEES October 1, 1997 $11 00 October 1, 1998 $11 50 October 1, 1999 $11 75 April 1, 2001 $12 50 DISCUSSION Excessive brush and bulky waste accumulations within the City of Fort Worth are a blight in numerous inner-city neighborhoods In an effort to gain control over this waste stream and support our strategic goals of "creating a cleaner and more attractive city" and "re-vitalizing the central-city neighborhoods", an intensive cleanup campaign must be undertaken The brush and bulky waste collection program will be enhanced City-wide Additional brush and bulky waste collections will be provided in targeted areas, as needed A vital component of this program will be a concentrated education campaign to reinforce to residents "the when", "the how'' and °the what" of brush and bulky waste collection Enforcement measures will be taken if voluntary compliance cannot be achieved City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 6/25/02 G-13660 52SLATE 2 of 2 SUBJECT CLEANING THE WASTE SLATE IN FORT WORTH, INCREASING THE SOLID WASTE ENTERPRISE FUND FEES The current fund balance of the Solid Waste Fund is insufficient to finance an enhanced brush and bulky waste cleanup effort, which includes expanded contractor and City services. In order to keep the Solid Waste Enterprise Fund fiscally sound, it is necessary to increase the monthly residential garbage rate by $1.25 effective July 1, 2002.
