HomeMy WebLinkAboutOrdinance 15051Ordinance No ~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $67,828.50 AND THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $52,786 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT TO M.E. BURNS CONSTRUCTION, INC. FOR 1998 CIP VARIOUS LOCATIONS, CONTRACT 2001 E UNIT I. WATER AND SEWER REPLACEMENTS, MAKING THIS ORDINANCE CUMULITIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2001-02 and in the Budget of the City Manager, there shall also be increased estunated receipts and appropriations in the Water Capital Project Fund in the amount of $67,828.50 and the Sewer Capital Project Fund in the amount of $52,786 from available funds for the purpose of funding a contract to M.E. Burns Construction, Inc. For 1998 CIP various locations, contract 2001 E Unit I. water and sewer replacements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 14745 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGALITY ~~ Assistant City Attorney ADOPTED AND EFFECTIVE. ~ ~ ~C./ 'a~- City of Fort Worth, Texas Mayor and Council Communication 3/26/02 REFERENCE C-19023 NAME 30PAVE PAGE 1 of 4 SUBJECT APPROPRIATION ORDINANCE AND AWARD OF CONTRACT TOM E BURNS CONSTRUCTION, INC FOR 1998 CIP VARIOUS LOCATIONS, CONTRACT 2001 E UNIT I WATER AND SEWER REPLACEMENTS, AND AWARD OF CONTRACT TO STABILE & WINN, INC FOR 1998 CIP VARIOUS LOCATIONS, CONTRACT 2001 E UNIT II PAVING IMPROVEMENTS, ALTERNATE NO 1 RECOMMENDATION It is recommended that the City Council Authorize the transfer of $120,614 50 from the Water and Sewer Operating Fund to the Water Capital Project Fund in the amount of $67,828 50, and the Sewer Capital Project Fund in the amount of $52,786 00, and 2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $67,828 50, and the Sewer Capital Project Fund in the amount of $52,786 00 from available funds, and 3 Authorize the City Manager to execute a contract with M E Burns Construction, Inc in the amount of $107,314 50 and 45 working days for 1998 Capital Improvement Program (CIP) Various Locations, Contract 2001 E Unit I Water and Sewer Replacements, and 4 Authorize the City Manager to execute a contract with Stabile & Winn, Inc. in the amount of $787,207 30 and 175 working days for 1998 CIP Various Locations, Contract 2001E Unit II Paving Improvements Alternate No 1 .DISCUSSION Contract 2001E consists of the following four street reconstruction projects Street Louis Street Fortune Road Fortune Road Simondale Drive From Craig Street Pelham Road Edgehill Road Biddison Street To Routt Street Clayton Road West Pelham Road Bellaire Drive South The 1998 CIP included funds for Louis Street (from Craig Street to Routt Street) COUNCIL DISTRICT 3 Undesignated Funds will be used to fund Fortune Road (from Pelham Road to Clayton Road West), Fortune Road (from Edgehill Road to Pelham Road), and Simondale Drive (from Biddison Street to Bellaire Drive South) The scope of the work includes the replacement of water and sewer utilities (Unit I) in Louis Street and Simondale Drive, and reconstruction of the pavement structure (Unit 11) in all four named streets Unit I City of Fort Worth, Texas Mayor and Council Communication 3/26/02 C-19023 30PAVE 2 of 4 SUBJECT APPROPRIATION ORDINANCE AND AWARD OF CONTRACT TOM E BURNS CONSTRUCTION, INC FOR 1998 CIP VARIOUS LOCATIONS, CONTRACT 2001 E UNIT I WATER AND SEWER REPLACEMENTS, AND AWARD OF CONTRACT TO STABILE & WINN, INC FOR 1998 CIP VARIOUS LOCATIONS, CONTRACT 2001 E UNIT II PAVING IMPROVEMENTS, ALTERNATE NO 1 will be funded by the Water Department. BID ADVERTISEMENT -This project was advertised for bid on October 25 and November 1, 2001 On December 13, 2001, the following bids were received Unit I Bidders (Water and Sanitary Sewer) Amount Time Of Completion M. Burns Construction, Inc. $107,314.50 45 Working Days S H U C ,Inc. $114,511 97 Rope Construction, Inc. $116,437 75 Burleson Utilities, Inc. $128,962 35 Cleburne Utility Construction Company, Inc. $129,374 50 William J Schultz, Inc. d/b/a Circle "C" $129,630 00 Construction Company Long Construction & Engineering, Inc. $136,431 00 Jackson Construction, Ltd $152,826 00 In addition to the contract cost, contingencies for change orders are $3,000 00 (water) and $2,300 00 (sewer) Associated costs for construction inspection and survey are $4,500 00 (water) and $3,500 00 (sewer) M/WBE - M E Burns Construction, Inc. is in compliance with the City's M/WBE Ordinance by committing to 14% M/WBE participation The City's goal on this project is 14% The bid documents for Unit II paving improvements included two alternates as follows Alternate No 1 included 5-inch HMAC (hot mix asphaltic concrete) pavement on 6-inch lime stabilized subgrade, construction of standard concrete curb and gutter, driveway approaches, and sidewalks where shown on the plans, and Alternate No 2 included 6-inch reinforced concrete pavement on 6-inch lime stabilized subgrade, construction of standard concrete curb, driveway approaches, and sidewalks where shown on the plans. City staff recommends that the paving contract be awarded to the second low bidder, Stabile & Winn, Inc M/WBE -Stabile & Winn, Inc. is in compliance with the City's M/WBE Ordinance by committing to 4% M/WBE participation and documenting good faith effort. Stabile & Winn, Inc. identified several subcontracting and supplier opportunities However, the M/WBEs contacted in the areas identified did not submit the lowest bids The City's goal on this project is 25% Fortune Road and Simondale Drive are located in COUNCIL DISTRICT 3, Mapsco 74S and 89D Louis Street is located in COUNCIL DISTRICT 5, Mapsco 80K.
