AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
ENVIRONMENTAL MANAGEMENT PROJECT FUND IN THE AMOUNT OF $71,806 FROM
AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH SNAP-ON TOOLS
FOR THE LEASE OF VEHICLE EMISSIONS TESTING EQUIPMENT, MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS
SECTION 1
That in addition to those amounts allocated to the various City departments for the Fiscal Year 2001-02 and in the Budget of
the City Manager, there shall also be increased estimated receipts and appropnations in the Environmental Management
Project Fund in the amount of $71,806 from available funds for the purpose of funding a contract with Snap-On Tools for the
lease of vehicle emission testing equipment.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason
by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions,
sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No 14745 and all other ordinances and appropriations amending the
same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and
appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly
repealed.
SECTION 4
This ordinance shall take effect upon adoption.

AGREEMENT WITH SNAP-ON INDUSTRIAL FOR VEHICLE EMISSION TESTING
EQUIPMENT
T RECOMMENDATION
It is recommended that the City Council
Approve the transfer of $71,806 from the Environmental Management Operating
undesignated engineering account to the Emissions Testing project within the
Environmental Project Fund, and
2. Adopt the attached appropriation ordinance increasing estimated receipts and
appropriations in the Environmental Management Project Fund by $71,806, and
3 Authorize the City Manager to execute an agreement with Snap-On Industrial to
lease vehicle emission testing equipment for snot-to-exceed amount of $71,806
based on annual lease payments of $14,361 11 per year for 5 years.
DISCUSSION
Effective May 1, 2002, as a result of the State of Texas' Motorist's Choice Vehicle
Emissions Testing Program, vehicle owners in the Houston-Galveston and Dallas-
FortWorth areas will be subject to new emissions testing requirements. The testing
will be integrated with the current annual safety inspection program administered by
the Texas Department of Public Safety The City of Fort Worth has approximately
2,000 gasoline and LPG fueled vehicles that will be subject to the new testing
requirements Currently, the City does not have the equipment necessary to
conduct the tests.
It is proposed that mobile emissions testing equipment for the Downtown and Harley
Street Service Centers be procured from Snap-On Industrial on a five-year
lease/purchase basis for a total cost of $71,806 A five-year warranty and
necessary training for City technicians on the use of the equipment are included in
the cost of the Iease~.At the end of the 5-year lease the City may purchase the two
pieces of equipment for a cost of $1 00 per machine. Additionally, if the State of
Texas revokes the new emissions testing program during the first two years of the
lease, the total cost of the lease will be reduced by $24,300 If the State revokes the
new emissions testing program after the initial two years of the lease, the cost of the
lease will be reduced by $675 per month for the remaining months of the lease, if
less than 5,000 inspections have been performed In the event the State scrapped
the new emissions testing program, the leased equipment would continue to be used
for diagnostic work on late model vehicles.
Outright purchase of the emissions testing equipment is estimated to cost
approximately $63,000 with only cone-year warranty, no provision for technician
training, and no consideration given if the State scrapped the program For that
reason, lease/purchase at a cost of $71,806 is believed to be the preferred means of
acquiring the required equipment.
Snap-on Industrial Tools is designated as a Qualified Information Systems Vendor
by the State of Texas Under Section 271 083 of the Texas Local Government
Code, a local government satisfies otherwise applicable competitive bidding
requirements when it makes a purchase through the State of Texas General Service
Commission Catalogue purchasing procedure established by Section 2157 061 of
the Texas Government Code The City will comply with that procedure for the
purchase agreement authorized under this Mayor and Council Communication
FISCAL INFORMATION/CERTIFICATION
The Director of Fiscal Services certifies that upon approval of above
recommendations, funds will be available in the current operating budget, as
appropriated, in the Environmental Management Project Fund

exceed $71,806 00 based on annual lease payments of $14,361 11 per year for 5 years
