AN ORDINANCE INCREASING ESTIMATED RECEII'TS AND APPROPRIATIONS
IN THE GRANTS FUND IN THE AMOUNT OF $152,000 FROM AVAILABLE
FUNDS, FOR THE PURPOSE OF FUNDING A CONTRACT WITH THE U.S. EQUAL
EMPLOYMENT OPPORTUNITY COMMISSION (EEOC), MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH,
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS.
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2002-2003 u- the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants
Fund in the amount of $152,000 from available funds, for the purpose of funding a contract with the U:S.
Equal Opportunity Commission (EEOC).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opimon or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No: 14745 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict with
such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

ORDINANCE AND AUTHORIZE AN INTERFUNb LOAN
RECOMMENDATION
It is recommended that the City Council
1 Authorize the City Manager to execute a contract with the U S Equal Employment Opportunity
Commission (EEOC) in an amount up to $152,000, and
2 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in an amount up to $152,000, and
3 Authorize anon-interest bearing interfund loan from the General Fund to the Grants Fund in the
amount of $50,667 for interim financing for this grant pending contract execution to ensure a smooth
transition from one grant funding period to another
DISCUSSION
In January 1977, the EEOC recognized the Fort Worth Human Relations Commission (FWHRC) as a
local deferral agency and a Fair Employment Practice (FEP) Agency in accordance with Section 706(c)
of the U S Equal Employment Opportunity Act of 1972, Title VII of the Civil Rights Act of 1964, as
amended Pursuant to this section, the EEOC, prior to asserting jurisdiction over employment
discrimination charges, defers such charges for resolution to a local or state agency having authority to
enforce a local or state fair employment law similar to Title VII, the Age Discrimination in Employment
Act and the Americans with Disabilities Act.
On August 8, 2002, the FWHRC, in accordance with EEOC Guidelines, submitted a request for
reimbursement as follows
• $8,300 for deferral of 166 non jurisdictional charges of discrimination at a cost of $50 per case, and
• $143,500 for resolution of 287 charges of alleged discrimination at a cost of $500 per case, and
• $1,000 for partial reimbursement of expenses relating to mandatory training at an EEOC sponsored
annual conference
Upon review of the FWHRC submittal, and receipt by EEOC of the congressional appropriation for
funding of FEP agencies, the finalized contracts will be forwarded to the FWHRC for execution by the
City Manager Historically this occurs late in the first trimester of the fiscal year
Under this contract, 50% of funds are usually paid at midyear and the remaining 50% are paid upon
completion of the contract. The interfund loan will provide program funding until payments are
received

The Finance Director certifies that upon adoption of the above recommendations, and the attached
appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the
Grants Fund After the contract is executed, interim financing will be returned to the General Fund
