ORDINANCE NO.
AN ORDINANCE APPOINTING FRANKLIN D. CLARK, JR., ANN Y.
COLLINS, DARCY A. DENO, NEMUEL E. PETTIE, JAMES E.
PRITCHARD, AND PATRICIA L. SUMMERS AS SUBSTITUTE
MUNICIPAL JUDGES FOR THE UNEXPIRED PORTION OF A ONE
YEAR TERM COMMENCING FEBRUARY 18, 2002 AND ENDING
MARCH 31, 2002 OR UNTIL A SUCCESSOR IS QUALIFIED AND
APPOINTED IN ACCORDANCE WITH STATE LAW; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That Franklin I) Clark, Jr , Ann Y Collins, Darcy A. Deno, Nemuel E. Pettie, James E.
Pritchard, and Patricia L Summers be appointed as substitute Municipal Judges for the
unexpired portion of a one year term commencing February 18, 2002 and ending March 31, 2002
or until a successor is qualified and appointed m accordance with state law
SECTION 2.
This ordinance shall be cumulative of all provisions of ordinances and of the Code of the
City of Fort Worth, Texas (1986j, as amended, except where the provisions of this ordinance are
m direct conflict with the provisions of such ordinances and Code, m which event such
conflicting provisions of such ordinances and Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared void, ineffective or
unconstitutional by the valid Judgment or final decree of a court of competent jurisdiction, such

ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same would have been enacted by
the City Council without the incozporation herein of any such void, ineffective or
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
This ordinance shall be in full force and effect from and after its passage, and it is so
ordam~d.

SUBJECT ADOPT AN ORDINANCE APPOINTING SUBSTITUTE MUNICIPAL JUDGES FOR THE

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance appointing Franklin D Clark, Jr ,
Ann Y Collins, Darcy A. Deno, Nemuel E Pettie, James E Pritchard, and Patricia L. Summers as
substitute Municipal Judges for the remainder of an unexpired one-year term commencing February 18,
2002, and ending March 31, 2002, or until a successor is qualified and appointed in accordance with
state law
DISCUSSION
Chapter 30, Section 30 00008 of the Government Code states that the governing body of the
municipality may appoint one or more qualified person to be available to serve for a Municipal Judge
who is temporarily absent due to illness, family death, continuing legal or judicial education programs,
or any other reason The presiding judge shall select one of the qualified persons appointed by the
governing body to serve during the absence of a Municipal Judge. The substitute judge, while serving
as a Municipal Judge, has all the powers and shall discharge all the duties of a Municipal Judge
All of the named persons cited above meet the qualifications prescribed for the Municipal Judge. The
appointments are necessary to fill vacancies created by the change in the magistrate procedures
requiring twenty-four hour/seven-days a week coverage by a Municipal Judge
On January 22, 2002, the Municipal Court Advisory Committee voted to recommend to the City Council
the above listed persons for appointment as substitute Municipal Judges at the current salary rate for
substitute judges.

The Finance Director certifies that funds are available in the current operating budget, as appropriated,
of the General Fund
