Ordinance No. ~~ AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $250,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING THE BOTANIC GARDEN GREENHOUSE DEVELOPMENT PROJECT, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTNE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2001-02 in the Budget of the City Manager, there shall also be increased estunated receipts and appropriations in the Special Trust Fund in the amount of $250,000 for the purpose funding the Botanic Garden Greenhouse Development Project.. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 14745 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. ' ~ ~ ~~ A City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 10/1/02 **C-19270 20BOT 1 of 4 SUBJECT APPROPRIATION ORDINANCE AND AWARD OF ARCHITECTURAL CONTRACT TO GSBS BATENHORST, INC FOR THE DESIGN OF PRODUCTION GREENHOUSE FACILITIES AT THE BOTANIC GARDEN RECOMMENDATION It is recommended that the City Council Find that material changes in conditions have rendered use of the 1986 Capital Improvement Program (CIP) funds designated for the development of the Botanic Garden Demonstration Garden as imprudent; and 2. Authorize reprogramming of the remaining funds from the 1986 CIP - Botanic Garden Demonstration Gardens, in the amount of $280,049, to the 1998 CIP -Botanic Garden Greenhouse Development project; and 3 Authorize the use of $250,000 from the Botanic Garden Parking Lot Lease Revenue Account for use in the Botanic Garden Greenhouse Development project; and 4 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund in the amount of $250,000 from available funds, and 5 Authorize the City Manager to execute a design contract with BSGS Batenhorst, Inc. in the amount of $74,750 for site master planning of the greenhouse facility area, and design and preparation of construction documents for Phase I development. DISCUSSION The 1998 CIP allocated $300,000 for the development of production greenhouses at the Botanic Garden Additionally, the 1986 CIP allocated $350,000 for the master planning and development of a demonstration garden in the vicinity of the existing production greenhouses On December 19, 1989 (M&C C-12056), the City Council approved award of design services to Elbert R. Spence, Architect/Landscape Architect in the amount of $55,230 for the master plan design for the Demonstration Garden project. The $2.3 million estimated cost of completing the Botanic Garden Demonstration Garden today exceeds the amount allocated in the 1986 CIP Due to a lack of funding to complete this project, it is not prudent to proceed with the Demonstration Garden project as anticipated in the 1986 bond package City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 10/1/02 **C-19270 20BOT 2 of 4 SUBJECT APPROPRIATION ORDINANCE AND AWARD OF ARCHITECTURAL CONTRACT TO GSBS BATENHORST, INC FOR THE DESIGN OF PRODUCTION GREENHOUSE FACILITIES AT THE BOTANIC GARDEN With the proposed reprogramming of the remaining $280,049 (less design, engineering and project management fees) from the 1986 CIP Demonstration Garden project, coupled with the $300,000 allocated for the 1998 CIP -Botanic Garden Greenhouse project and the allocation of $250,000 from lease revenue receipts, a total project budget of $830,049 exists The Parks and Community Service Department (PACSD) will be able to design and construct production greenhouses used for plant material propagation, collection of rare and unusual plants for public display, and plant species collection Additionally, the proposed facility will provide educational facilities for the public to experience hands-on demonstrations related to greenhouse operations and plant propagation and maintenance, as well as providing facilities for the volunteer labor force used in annual color production The proposed facility will consist of two greenhouse structures, a plant shade area structure, a small visitor area for training and education purposes, a staff administrative area, restroom facilities and associated site improvements The production greenhouses will be relocated to the southwest corner of the Botanic Garden grounds, which will require using the eastern portion of the existing parking facility currently under lease from .the City to Mid-Western Development and Realty Company for Lockheed Martin employee parking The facility will be accessed off the westbound IH-30 frontage road west of University Drive The relocation of these facilities is in conformance with the Botanic Garden Master Plan Additionally, reprogramming of Demonstration Garden funds for the relocation and development of the production greenhouses will enable accomplishment of a major component of the overall Demonstration Garden project scope In addition to basic design services, the architect will prepare a master development plan for future greenhouse facility improvements, prepare detailed cost estimates, perform boundary and topographic surveys, prepare construction documents and specifications for furnishings, and assist the City in review of product submittal and resolution of construction quality control issues. GSBS Batenhorst, Inc of Fort Worth is being recommended by Botanic Garden staff as the project consultant due to its expertise and background in the area of greenhouse production design Transportation and Public Works Department (TPW), Architectural Services staff concurred with PACSD's recommendation after reviewing the qualifications of architects requesting to be considered for City projects The Fort Worth Garden Club and the Fort Worth Botanical Society have endorsed the reprogramming of Demonstration Garden funds for this project. GSBS Batenhorst, Inc. is in compliance with the City's M/WBE Ordinance by committing to 26% M/WBE participation The City's goal on this project is 20% ~.
