ORDINANCE NO. ~~~ ~~
AN ORDINANCE EXTENDING A MORATORIUM ON ACCEPTANCE
OF CONCEPT PLANS, PRELIMINARY PLATS, UNIFIED
RESIDENTIAL DEVELOPMENT SITE PLANS, AND APPLICATIONS
FOR BUILDING PERMITS AND OTHER DEVELOPMENT PERMITS
FOR CERTAIN PROPERTIES LOCATED IN THE VICINTY OF THE
WESTERN SHORE OF LAKE ARLINGTON, SOUTH OF THE 6100
BLOCK OF RAMEY AVENUE, EAST OF THE 2800-5300 BLOCKS OF
INTERSTATE LOOP 820 AND NORTH OF INTERSTATE 20, PENDING
CONSIDERATION OF REZONING OF SUCH PROPERTIES;
PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING
A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council has considered rezomng certain properties located m the
vicinity of the western shore of Lake Arlington, south of the 6100 block .of Ramey Avenue, east
cf the 2800-5300 blocks of Interstate Loop 820 and north of Interstate 20 under Case No ZC-O1-
017,
WHEREAS, the City Council has previously approved the rezomng of certain parcels
and denied the rezomng of other parcels m Case No ZC-O1-017,
WHEREAS, four areas remain to be considered for rezomng m Case No ZC-O1-017,
described as Areas 9, 10, 15 and 17 (the "Property"), as shown on Attachment "A" and depicted
on the map attached as Attachment "B",
WHEREAS, on November 20, 2001, the City Council adopted Ordinance No 14868
establishing a 95-day moratorium expiring February 22, 2002, on the acceptance of applications
for development of the Property m order to maintain the status quo pending consideration of
~~' rezomng the Property;
WHEREAS, the City Council heard testimony concerning rezoning the Property on
February 13, 2002, and continued the hearing to March 19, 2002 for further consideration of a
conceptual redevelopment plan for the Lake Arlington area and additional discussions with
owners of the Property concerning the proposed rezomngs,
WHEREAS, Area 9 is currently zoned "E" Neighborhood Commercial, Area 10 is
currently zoned "B" Two-Family, Area 15 is currently zoned "IP" Industrial Park and Area 17 is
currently zoned "J" Medium Industnal,
WHEREAS, on March 19, 2002, the City Council will consider rezoning Area 9 to "A-
5" One-Family, Area 10 to "A-10" One-Family, Area 15 to a Planned Development for all uses
allowed in "A-10" One-Family and a stable, and Area 17 to "A-7 5" One-Family;
WHEREAS, rt is advisable to extend the moratorium to April 5, 2002 to maintain the
status quo while the City Council considers rezoning Areas 9, 10, 15 and 17,
WHEREAS, all findings m Ordinance No 14868 are reaffirmed,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, AS FOLLOWS
SECTION 1.
The expiration of the moratorium on acceptance of concept plans, prehmmary plats,
x unified residential development site plans, and applications for building permits and other
development permits for the Property enacted pursuant to Ordinance No 14868, is hereby
extended from February 22, 2002 to April 5, 2002 at 11 59 p.m., or until the City Council
terminates the moratorium, whichever occurs first. As reflected m Section 3 of Ordinance No
14868, applications for development of Area 10 consistent with "A-10" One-Family or more
restrictive one-family residential regulations are not subject to the moratorium.
SECTION 2.
All provisions of Ordinance No 14868, with the exception of the expiration date
extended by Section 1 of this Ordinance, shall remain in full force and effect.

SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared void, ineffective or
unconstitutional by the valid judgment or final decree of a court of competent ~unsdiction, such
voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation herein of any such void, ineffective or
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
This ordinance shall take effect upon adoption.

SUBJECT EXTENSION OF MORATORIUM ON ACCEPTANCE OF APPLICATIONS FOR
DEVELOPMENT OF CERTAIN PROPERTY IN THE VICINITY OF THE WESTERN

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance extending the moratorium to April
5, 2002, for acceptance of applications for development permits for certain property located generally
along and near the western shore of Lake Arlington and south of the 6100 block of Ramey Avenue,
east of the 2800-5300 blocks of Interstate Loop 820, and north of Interstate 20
DISCUSSION
Adoption of the attached ordinance would extend the moratorium on the four remaining areas in the
vicinity of Lake Arlington pending further consideration by the City Council of rezoning of the property in
Zoning Case No ZC-01-017 The City Council has previously rezoned some tracts in the area and
denied rezoning requests for certain other tracts
The moratorium applies to Areas 9, 10, 15 and 17, as shown on the exhibits attached to the ordinance
Area 9 is currently zoned "E" Neighborhood Commercial, Area 10 is zoned "B" Two-Family, Area 15 is
zoned "IP" Industrial Park, and Area 17 is zoned "J" Medium Industrial Area 9 is proposed to be rezoned
to "A-5" One-Family Area 10 is proposed to be rezoned to "A-10" One-Family Area 15 is proposed to be
rezoned to a Planned Development for all uses in "A-10" One-Family and a stable. Area 17 is proposed to
be rezoned to "A-7.5" One-Family The moratorium would not apply to applications to develop Area 10 in
compliance with "A-10" One-Family or more restrictive One-Family residential regulations.
Zoning Case No ZC-01-017 will be considered by the City Council on March 19, 2002. Adoption of the
attached ordinance would extend the moratorium from February 22, 2002 to April 5, 2002. The purpose
of the extension of the moratorium is to enable the City Council to consider the rezoning of the property
before the moratorium expires
