ORDINANCE NO.~ AN ORDINANCE VACATING AND EXTINGUISHING A 16 FOOT WIDE ALLEY, LOCATED BETWEEN LOTS 1 THROUGH 24, BLOCK 13 AND LOTS 1, 2, 23, 24, BLOCK 28 PROSPECT HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT a 16 foot wide alley, located between Lots 1 through 24, Block 13 and Lots 1, 2, 23, and 24, Block 28 Prospect Heights Addition, City of Fort Worth, Tarrant County, Texas, and containing approximately 0.258 acres, as recorded in Volume 63, Page 53, Plat Records, Tarrant County, Texas and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated and extinguished SECTION 2. That the fee to the land in the above described vacated alley is hereby released and shall revert to the adjacent owners as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict here ith are hereby repealed SECTION 4. OF BRENT A M/ZELL REGISTERED PROFESSIONAL LAND SURVEYOR TExAS REGISTR4AON NO. 1967 JULY 31, 2002 SCALE. 1 "=100' ~;/~` ~ EXHIBIT b ~ ~~ ~ pF ~ -- 0?.1~-- 0~1-r City of Fort Worth, Texas Mayor and Council Communication R 12/17/02 PZ-2449 06VA-02-074 1 of 1 SUBJECT ALLEY VACATION PORTIONS OF AN ALLEY WITHIN BLOCKS 13 AND 28, PROSPECT HEIGHTS ADDITION, CITY OF FORT WORTH, TEXAS (VA-02-074) RECOMMENDATION It is recommended that the City Council adopt the attached ordinance vacating a 16-foot wide portion of an alley within Lots 1 through 24, Block 13, and between Lots 1, 2, 23, and 24, Block 28, Prospect Heights Addition, according to the Plat recorded in Volume 63, Page 59 of the P R.T C T and containing a total of 0.258 acres, plus or minus DISCUSSION The Fort Worth Independent School District, owner of the above-described properties, has requested vacation of the referenced portions of an alley to expand a building area The existing improvements include paving, sanitary sewer, gas and electric lines Said alley shall be retained as a utility easement for the above mentioned utilities. The City Plan Commission recommended approval at its public hearing on September 25, 2002 The Engineering Department, Real Property Services Division states that a fee of $1 00 will satisfy the public interest. The reviewing City departments and public utility companies have raised no objections to this request.
