OF THE CITY OF FORT WORTH, BEING ORDINANCE NO. 13896, AS AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY OF FORT WORTH, BY AMENDING CHAPTER 5, "SUPPLEMENTAL USE STANDARDS" TO ADD REGULATIONS FOR BOARDING HOUSES; TO AMEND SECTION 4.603, THE RESIDENTIAL DISTRICT USE TABLE AND SECTION 4.803, THE NONRESIDENTIAL DISTRICT USE TABLE TO REFLECT WHEN BOARDING HOUSES ARE PERMITTED; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, boarding houses are allowed by right in Fort Worth. in the medium density ("C") and, high. density ("D") multifamily districts and the low intensity ("MU-1") and high intensity ("MU-2") mixed-use distncts, WHEREAS, boarding houses serve a legitimate housing need in the City of Fort Worth, WHEREAS, it is advisable to clanfy the definition of boarding houses in the Fort Worth Zoning Ordinance in order to distinguish them from apartments, extended stay hotels and bed and breakfast inns, and WHEREAS, it is the intent of the following regulations to establish additional supplemental development standards and operational regulations that will address health and safety issues related to boarding houses, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. Chapter 5, Article 1, of Ordinance No. 13896, the Zoning Ordinance of the City of Fort Worth, is hereby amended to add a new section, Section 5 107A, entitled "Boarding Houses" to provide supplemental use standards and regulations for boarding houses to read as follows. 5.017 A: Boarding Houses Boarding Houses may be permmtted in accordance with the Use Tables in Chapter 4, Articles 6 and 8, subject to the following conditions. 1 The term "Boarding Houses" shall also include Lodging Houses. 2. Each boarding house shall be a single structure containing assigned rooms for residents. 3 No more than one boarding house per individual tract, parcel, or platted lot is allowed. 4 A boarding house must be constructed in compliance with all applicable requirements of the "Boarding House (not transient)" provisions of the Building Code. 5 No more than two (2) occupants per sleeping room are allowed. 6. All sleeping room size shall be a minimum size of 70 square feet for one occupant and 120 square feet for two occupants. 7. Public ingress and egress to the boarding house shall be through one common exterior entrance. Ingress and egress for boarders shall be through common exterior entrances. 8 Entry access to all boarding rooms shall be through the interior of the building. No exit doors from individual boarding rooms shall lead directly to the exterior of the building. 9 Residents must have access on site to shared common areas for cooking and eating. A common kitchen facility equipped for cooking meals located on site must be available to the residents, or daily meals must be provided on site for the residents of the boarding house. 10 No cooking is perrrutted m any sleeping room. No cooking facilities are permitted in any sleeping room. 11 Each floor must contain. at least one fully-equipped bathroom for each five residents that is accessible from a common hallway 12. Each boarding house shall have a resident manager 13 All residents must execute a lease before occupancy 14 Rooms must be leased to the same resident for at least seven (7) consecutive calendar days. 15 Parking spaces shall be provided as follows. one space for the resident manager; one space per leased sleeping room, and one space per four employees. 16. Owner of the boarding house must obtain a certificate of occupancy and register with the Multifamily Inspection Program before operating a boarding house. SECTION 2. All boarding houses must comply with the requirements of Subsectiops 5, 12, 13, and 14 of 5 107A listed in Section 1 no later than January 1, 2003 SECTION 3. Chapter 4, Article 6, of Ordinance No. 13896, the Zoning Ordinance of the City of Fort Worth, Section 4 603, "Residential District Use Table", "Residential Uses", "Group Living" is hereby amended by adding an asterisk to the permitted uses for the column headings "MLJ-1", "MU-2", "C", "D" and "PD" districts and to add a reference in the "Supplemental Standards" column to Section 5 107A for "Boarding Houses" under "Residential Uses", "Group Living." SECTION 4. Chapter 4, Article 8, of Ordinance No. 13896, the Zoning Ordinance of the City of Fort Worth, Section 4 803 "Nonresidential District Use Table" is hereby amended to add the term "Boarding Houses" to "Group Living" in the "Residential Uses" section, to permit boarding houses in the column headings for "MU-1" and " MU-2" distracts, to add an asterisk to the permitted uses for the column headings "MU-I" and "MU-2" distracts and to add a reference in the "Supplemental Standards" column to Section 5107A for "Boarding Houses" under "Residential Uses," "Group Living." SECTION 5. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 6, It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, :~ paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. Any person, firm, or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation exists shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No. 13896 which have accrued at the time of the effective date of this ordinance and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authonzed by Section 52.013, Texas Local Government Code.
