ORDINANCE NO. /_Sa~/ AN ORDINANCE VACATING AND EXTINGUISHING A 26-FOOT EMERGENCY ACCESS EASEMENT LOCATED IN LOT 8, BLOCK 9, SETTLEMENT PLAZA ADDITION, THE CITY OF FORT WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT an emergency access easement, approximately 26 feet wide by variable length, containing 3,665 30 square feet, located in Lot 8, Block 9, Settlement Plaza Addition, an addition to the City of Fort Worth, Texas, as recorded in Cabinet A, Slide 5306, Plat Records of Tarrant County, Texas, and as more specifically described in Exhibit A attached hereto and incorporated herein by reference be and the same is vacated and extinguished SECTION 2. That the fee to the land in the above described public access easement is hereby released and shall revert to the adjacent owner as provided by law SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. EASEMENT VACATION FIELD NOTE' Field notes for the vacation of a 26--foot wide temporary emergency access easement. BEING part of the T O. Moody Survey, Absfracf No. 1069, situated in the western part of the City of Fort Worth in Tarrant Caunty, Texas; and being a portion of Lot 8, Block 9, Sett/ement P/aza Addition, an addition to the City of Fort Worth, according to the plat filed in Cabinet A, Slide 5306, Plat Records, Tarrant County, Texas, said easement vacation being more particularly described os follows: BEG/NN/NG at the saufhwest corner of Lot 8, Block 9, said Settlement Plaza Addition said point also being in the easter/y righf-of--way line of Academy Boulevard (a 120' public right-of--way) and also being the northwest corner of Lot 1, Block 1, Cornerstone Addition, an addition to the City of Fort Worth, according to the p/at filed in Cabinet B, Slide 1586, said Plot Records; THENCE North 00' 21' 05" East, along the westerly line of Lot 8, Block 9, said Sett/ement Plaza Addition and the easterly line of said Academy Boulevard, a distance of 26 00 feet; THENCE South 89' 40' 28" East, leaving the westerly line of Lot 8, Block 9, said Sett/ement P/aza Addition and the easterly line of said Academy Boulevard, a distance of 126 35 feet to a point in the easterly line of Lot 8, Block 9, said Sett/ement P/aza Addition and the westerly line of Parkmere Drive (a 50' public right-of--way) said point being the beginning of a non-fongent curve to the left having a central angle of 55'44'05", a radius of 59 50 feet and a chord bearing and distance of S 61'48'26" E, 55.62 feet, THENCE along the easter/y line of Lot 8, Block 9, said Settlement Plozo Addition, the westerly line of said Parkmere Drive .and said curve to the left an arc distance of 5788 feet to a point in the south line of Lot 8, Block 9, said Settlement Plaza Addition said point a/so being in the north line of Lot 1, Block 1, said Cornerstone Addition, THENCE North 89' 40' 28" West, along the south line of Lot 8, Block 9, said Settlement P/aza Addition and fhe north line of Lot 1, Block 1 said Cornerstone Addition, a distance of 175.51 feet to fhe POINT OF BEGINNING and containing 3,665.30 square feet of land. DISCUSSION James Melino of West Loop 820 Partners of Dallas, Texas, owner of the above-described property, has requested vacation of the referenced emergency access easement to expand a yard and building area There are no known utilities in the said easement. ' The Engineering Department, Real Property Services Division states that a fee of $1 00 will satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request.
