HomeMy WebLinkAboutOrdinance 15192i "'},~ r ORDINANCE NO. ~~~~ AN ORDINANCE VACATING AND EXTINGUISHING A 2.13 ACRE PORTION OF PENN STREET LOCATED ADJACENT TO THE SOUTHWEST CORNER OF LOT 16, OARLOCK'S ADDITION, FORT WORTH, TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HERE-WITH, AND PROVIDING AN EFFECTIVE DATE. PENN STREET ABANDONMENT City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE NUMBER LOG NAME PAGE 8/13/02 PZ-2404 06VA-02-061 1 of 1 SUBJECT PENN STREET PARTIAL VACATION AND PURCHASE WAIVER REQUEST, OARLOCKS ADDITION, FORT WORTH, TEXAS (VA-02-061) RECOMMENDATION It is recommended that the City Council adopt the attached ordinance vacating an approximate 2.13 acre portion of Penn Street located adjacent to the southwest corner of Lot 16, Oarlock's Addition, City of Fort Worth, as recorded in the Plat Records of Tarrant County, Texas. The attached ordinance shall not take effect until a final plat of Penn Street is recorded in the Plat Records. DISCUSSION r Pier One Imports, Inc. (Pier One), owners of the adjacent above affected property, has requested vacation of the afore described portion of the Penn Street right-of-way to enable the applicant to incorporate the property into the overall new corporate headquarters development. See the attached Exhibit "A" for location and description of the street segment requested to be vacated The City Plan Commission recommended vacation of said right-of-way at its public hearing meeting on July 27, 2002, subject to either the retention of utility easements or relocation of same at the owner's expense. The Commission further stipulated that an acceptable re-plat, incorporating the exact vacated street portion therein, be submitted and approved prior to recordation of said plat. The Engineering Department, Real Property Services Division has established a value for the 2 13 acres of requested street right-of-way vacation at $463,452.45, based upon a square foot value of $5 00 Reviewing City departments and public utility companies have raised no objection to this request. The value of the right-of-way will be credited towards the City's participation in the Economic Incentive Agreement between the City and Pier One. It is anticipated that a proposed Economic Incentive Agreement will be presented to the City Council in Fall 2002. This property is located in COUNCIL DISTRICT 9 FISCAL INFORMATION/CERTIFICATION The Finance Director certifies that this action will have no material effect on City funds.
