AN ORDINANCE VACATING AND EXTINGUISHING A 102.50-FOOT
LONG BY 1.00-FOOT WIDE UTILITY EASEMENT LOCATED IN LOT 21,
BLOCK 9, HARVEST RIDGE ADDITION, AND A 102.50-FOOT LONG
BY 1 00-FOOT WIDE UTILITY EASEMENT LOCATED IN LOT 23,
BLOCK 9, HARVEST RIDGE ADDITION TO THE CITY OF FORT
WORTH, TEXAS; PROVIDING FOR REVERSION OF FEE IN SAID
LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT a 102 50-foot long by 1 00-foot wide utility easement containing 102 50
square feet, situated in Lot 21, Block 9, Harvest Ridge Addition, and a 102 50-foot long
by 1 00-foot wide utility easement containing 102 50 square feet, situated in Lot 23,
Block 9, Harvest Ridge Addition, being part of the Jose Chirino Survey, Abstract 265 in
the northern part of Fort Worth in Tarrant County, Texas, and as recorded in Cabinet A,
Slide 7164, Plat Records of Tarrant County, Texas, and as more specifically described
in Exhibit A attached hereto and incorporated herein by reference, be and the same are
vacated and extinguished
SECTION 2.
That the fee to the land in the above described vacated utility easements is
hereby released and shall revert to the adjacent owner as provided by law
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed

That this ordinance shall take effect upon adoption

Field notes for the vacation of a 1-foot wide portion of a 10-foot wide
utility easement:
BEING part of the Jose Chirino Survey, Abstract No. 265, situated in the
norfhern part of Fort Worth in Tarrant County, Texas; and being o portion
of Harvest Ridge Addition, an addition to fhe City of Fort Worth, os
recorded by the plot tiled in Cabinet A, Slide 7164, Plot Records, Tarrant
County, Texas, sold easement vocofion being more particularly described os
follows:
COMMENCING of the northeast corner of Lot 21, Block 9, of said Harvest
Ridge Addition, said poinf also being in the westerly right-of--way line of
Harvest Ridge Road (a 60-foot wide public right-of--way);
THENCE South 40' 21' 00" West, along the easterly line of said
Lot 21 and the westerly line of sold Horvesf Ridge Road, a distance of
4.00 feet to the POINT OF BEGINNING of the herein described tract,
THENCE South 40' 21' 00" West, continuing along the eoster/y line of said
Lot 21 and the westerly line of said Horvesf Ridge Road, o distance of
1.00 foot to a point in the southerly line of on existing f0-foot wide
utility easement;
THENCE North 49' 39' 00" West, leaving the easterly line of said Lot 21
and the westerly line of said Harvest Ridge Rood, and along the southerly
line of sold 10-foot wide utility easement, o distance of 102.50 feet to 0
point in the easterly line of an existing 15-foot wide uttlity easement;
THENCE North 40' 21' 00" East, leaving the southerly line of said 10-foot

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating two 102.50 feet by 1
foot utility easements along Lots 21 and 23, Block 9, containing. 102.50 square feet each, Harvest
Ridge Addition, being part of the Jose Chirino Survey, Abstract No 265, situated in the northern part of
Fort Worth in Tarrant County, Texas, and being a portion of Harvest Ridge Addition, an addition to the
City of Fort Worth, as recorded by the plat filed in Cabinet A, Slide 7164, Plat Records, Tarrant County,
Texas
DISCUSSION
Weekley Homes, L.P and Horizon Homes, Ltd , owners of the .above described property, have
requested vacation of these utility easements to facilitate replatting with the adjoining land and to
expand yard area
The Engineering Department, Real Property Services Division states that a fee of $1 00 will satisfy the
public interest. Reviewing City departments and public utility companies have raised no objections to
this request. An acceptable replat has been received
This request is located in COUNCIL DISTRICT 2.

The Finance Director certifies that this action will have no material effect on City funds
