AN ORDINANCE VACATING AND EXTINGUISHING TWO ALLEYS AND
AN UTILITY EASEMENT, ALL LOCATED IN THE VAN ZANDT
HILLSIDE ADDITION TO THE CITY OF FORT WORTH, TEXAS;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1
THAT the following alleys and utility easement located in Van Zandt Hillside
Addition, and as more specifically described in the exhibits attached hereto and
incorporated herein by reference be and the same are vacated and extinguished
A 16-foot wide alley situated between Lots 3R-1, Lots 12 through 17, and Lot
18R, Block 6, Van Zandt Hillside Addition as recorded in Volume 204, Page 4,
Plat Records, Tarrant County, Texas, and containing 8,179 square feet, and as
more specifically described in Exhibit A, attached hereto and incorporated herein
by reference
2 A 16-foot wide alley situated between Lots 3R-1 and 2R, Block 6, Van Zandt
Hillside Addition, as recorded in Volume 204, Page 4, Plat Records, Tarrant
County, Texas, and containing 2,692 square feet, and as more specifically
described in Exhibit B, attached hereto and incorporated herein by reference
3 A 5-foot wide utility easement, situated in Lots 1 R and 2R, Block 6, Van Zandt
Hillside Addition, as shown on plat recorded in Volume 388-71, Page 292, Plat
Records, Tarrant County, Texas, and containing 498 65 square feet, and as
more specifically described in Exhibit C, attached hereto and incorporated herein
by reference,
SECTION 2.
That the fee to the land in the above described alleys and utility easement are
hereby released and shall revert to the adjacent owner as provided by law
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed
SECTION 4.
That this ordinance shall take effect upon adoption

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating the following alleys and
utility easement: '
A 16-foot wide alley situated between Lots 3R-1, 12 through 17, and 18R, Block 6, Van Zandt
Hillside Addition, an addition to the City of Fort Worth, as recorded in Volume 204, Page 4,
Plat Records of Tarrant, Texas, and containing 8,179 square feet; and
A 16-foot wide alley situated between Lots 3R-1 and 2R, Block 6, Van Zandt Hillside Addition,
as recorded in Volume 204, Page 4, Plats Records of Tarrant County, Texas, and containing
2,692 square feet; and
A 5-foot wide utility easement situated in Lots 1 R and 2R, Block 6, Van Zandt Hillside
Addition, as recorded in Volume 388-71, Page 292, Plat Records, Tarrant County, Texas, and
containing 498 65 square feet.
DISCUSSION
Dr Richard Rafes and Steve Russell of the University of North Texas, Fort Worth, Texas, owners of the
above-described properties, have requested vacation of the referenced alleys and' utility easement.
Existing improvements in the said alleys include paving, telephone lines, electric lines, fences/walls,
and sewer and gas lines with no known utility in the said utility easement. Said alleys to be retained as
utility easement for existing sewer, water and TXU Gas utilities.
The City ('Ian Commission recommended approval at :its' Public Hearing on January 23 arid August 28,
2002, respectively
The Engineering Department, Real Property Services Division states that a fee of $1,076 99 will satisfy
the public interest. Reviewing City departments and public utility companies have raised no objections
to this request. An acceptable replat-has been provided
