BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That a portions of a public access casement situated in the John Edmonds Survey Abstract No, 457, and being a part of Lot 5, Block b. Sundance Southwest Addition, an addition to the City of Tort Worth. Texas, containing approximately 0,225 acres of land, and as recorded in Cabinet A. Slide 12877 of the Plat Records of Tarrant County, Texas, and as more specifically described in Exhibits A and B. attached hereto and incorporated herein by reference, be and the same is vacated, abandoned and extinguished, SECTION 2. That the fee to the land in the above described vacated public access casement is hereby released and shall revert to the adjacent owner as provided by ht%v. SECTION 3. SundGnCe Southwest Addition, the City uf Fort Worth, Tarrant County, Texas; and 2. Waive any and all purchase fee value Of the vacated land in accordance with City policy (M&CG- 15824). DISCUSSION: Allen Ridinger Consulting, Inc,, on behalf of Parkwood 38, Limited, has requested to vacate the above referenced public access easement in order k} realign it within the lot. The applicant needs more parking than was originally planned for this lot and needs t0 realign the access easement accordingly t0 accommodate the additional parking. The City Plan Commission recommended approval of this request 8t its meeting oU November 21.20O8.An acceptable rep|at(FS^D8^273) has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The City of Fort Worth (City) originally obtained the above mentioned right-of-way through the platting process. The City does not own land under or adjacent to the above referenced right-of-way. Since noCity funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof iS recommended Uy staff k)bewaived.
