ORDINANCE NO. I -( ( l AN ORDINANCE VACATING THREE UTILITY EASEMENTS 20 FEET WIDE BY VARIABLE LENGTHS AND CONTAINING APPROXIMATELY 0 776 ACRES, AND SITUATED IN THE B B. B & C R.R. COMPANY SURVEY, ABSTRACT 201, FORT WORTH, TARRANT COUNTY TEXAS, PROVIDING FOR REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That three utility easements 20 feet wide and of variable lengths and containing approximately 0 776 acres, situated in the B B B & C R.R. Company Survey, Abstract No 201, Tarrant County, Texas, as recorded in Volume 13359, Page 157, Deed Records, Tarrant County, Texas, and as more specifically described in Exhibits "A", "B" and "C" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished SECTION 2 That the fee to the land in the above described vacated sanitary sewer and utility easements are hereby released and shall revert to the adjacent owner as provided by law ~ r. t r SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed SECTION 4. COMPANY SURVEY, ABSTRACT NO 201, FORT WORTH, TARRANT COUNTY, TEXAS (VA-01-1020) RECOMMENDATION It is recommended that the City Council adopt the attached ordinance vacating three 20-foot wide by variable length segments of sanitary sewer utility easements situated in the B B B & C R.R. Company Survey, Abstract No 201, Tarrant County, Texas, being a portion of Tract 2 described by deed to Continental Homes of Dallas, L.P as recorded in Volume 13359, Page 157, Deed Records, Tarrant County, Texas, and containing a gross aggregate of approximately 0 776 acres DISCUSSION Continental Homes of Dallas, L P of Grapevine, Texas, owner of the above described adjacent property, has requested vacation of three sanitary sewer utility easements to enable subdivision expansion The Engineering Department, Real Property Services Division states that a fee of $1 00 will satisfy the public interest. Reviewing City departments and public utility companies have raised no objections to this request.
