AN ORDINANCE EXTENDING A MORATORIUM ON ACCEPTANCE
OF CONCEPT PLANS, PRELIMINARY PLATS, UNIFIED
RESIDENTIAL DEVELOPMENT SITE PLANS, AND APPLICATIONS
FOR BUILDING PERMITS AND OTHER DEVELOPMENT PERMITS,
EXCEPT FOR DEVELOPMENT PERMITS CONSISTENT WITH "A-7.5"
ONE-FAMILY RESIDENTIAL ZONING, FOR PROPERTIES LOCATED
SOUTH OF INTERSTATE 30 EAST, IN THE 2000-2200 BLOCK OF
COOKS LANE, BEING A PART OF THE MADDEN, C P SURVEY, A-
1012; TRACTS3 1S, 1P1, 1, 1R, 1N, 1Q, 1P, 1M, 1L, PENDING
CONSIDERATION OF REZONING OF SUCH PROPERTIES,
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, on January 9, 2001, the City Council approved Mayor and Council
Communication G-13125 authorizing the City Manager to initiate rezoning of properties located
south of Interstate 30 East, east and west of the 1700-2300 blocks of Cooks Lane (the
"Property"), to "A-7 5" One-Family Residential m conformance with the 2000 Comprehensive
Plan,
WHEREAS, the Crty Council enacted Ordinance No 14473 on January 9, 2001,
establishing a 120-day moratorium on the acceptance of concept plans, preliminary plats, Unified
Residential Development site plans, and applications for building permits and other development
permits for the development of the Property;
WHEREAS, on March 20, 2001 the City Council finally resolved the rezoning requests
for the Property and terminated the moratorium, with the exception of those tracts located in the
2000-2200 Block of Cooks Lane and being a part of the Madden C P Survey, A-1012, Tracts 1S
1 P 1, 1, 1 R, 1 N, 1 Q, 1 P, 1 M, and 1 L, which are set for special hearing on June 5, 2001,
WHEREAS, said tracts located in the 2000-2200 blocks of Cooks Lane, being a part of
the Madden, C P Survey, A-1012 are shown on Attachment "A",
WHEREAS, it is advisable to extend the moratonum to June 22, 2001, to allow the City
Council time to consider rezoning those tracts located m the 2000-2200 Block of Cooks Lane,
being a part of the Madden, C P Survey, A-1012, as shown on Attachment "A", to "A-7 5" One-
Family Residential,
WHEREAS, all findings m Ordinance No' 14473 are reaffirmed,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, AS FOLLOWS
SECTION 1
The expiration of the moratonum on acceptance of concept plans, preliminary plats,
unified residential development site plans, and applications for building permits and other
development permits for the property located m 2000-2200 Block of Cooks Lane and being a
part of the Madden, C P Survey, A-1012, Tracts 1 S, 1 P 1, 1, 1 R, 1N, 1 Q, 1 P, 1 M, and 1L, more
particularly shown m Attachment "A", enacted ,pursuant to Ordinance No 14473, is hereby
extended from May 9, 2001 to June 22, 2001 at 11 59 p.m., or until the City Council terminates
the moratonum, whichever occurs first.
SECTION 2.
All provisions of Ordinance No 14473, with the exception of the expiration date
extended by Section 1 of this Ordinance, shall remain in full force and effect.
SECTION 3.
It is hereby declared to be the intention of the City Council that the sections, paragraphs,
sentences, clauses and phrases of tins ordinance are severable, and, if any phrase, clause,

sentence, paragraph or section of this ordinance shall be declared void, ineffective or
unconstitutional by the valid judgment or final decree of a court of competent ~unsdiction, such
voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases,

clauses, sentences, paragraphs and sections of this ordinance, since the same would have been
enacted by the City Council without the incorporation herein of any such void, ineffective or
unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 4
This ordinance shall take effect upon adoption.

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance extending the moratorium to June
22, 2001 for acceptance of concept plans, preliminary plats, Unified Residential Development site
plans, and applications for building permits and other development permits for certain property south of
interstate Highway 30 East, being lots in the 2000-2200 block of Cooks Lane, and being a part of the
Madden, C P Survey, A-1012
DISCUSSION
On January 9, 2001 (M&C G-13125), the City Council authorized the City Manager to initiate rezoning
of the property south of Interstate 30 East, east and west of the 1700-2300 blocks of Cooks Lane (the
Property) to "A-7 5" One-Family Residential..
The Property was designated for single-family residential development in the Comprehensive Plan but
was zoned for commercial or multi-family use Rezoning to "A-7 5" One-Family Residential would
permit the development of single-family residential dwellings on lots with areas of 7,500 square feet or
.greater, and other such uses as churches and schools, but would prohibit two-family, multi-family and
commercial development.
On January 9, 2001 (M&C G-13126), the City Council also adopted Ordinance No 14473 establishing a
120-day moratorium on the acceptance of applications for development of the Property in order to
maintain the status quo pending consideration of rezoning the property to "A-7 5" One-Family
Residential, consistent with the Comprehensive Plan Included in the moratorium were those tracts of
land in the 2000-2200 block of Cooks Lane, being a part of the Madden, C P Survey, A-1012
On March 20, 2001, the City Council resolved the rezoning requests for the Property and terminated the
moratorium, with the exception of those tracts located in the 2000-2200 blocks of Cooks Lane and
being a part of the Madden C P Survey, A-1012 (Tracts 1 S, 1 P 1, 1, 1 R, 1 N, 1 G2, 1 P, 1 M and 1 L as
shown in Attachment "A" to the attached ordinance) which are set for special hearing on June 5, 2001
Adoption of the attached ordinance would extend the moratorium from May 9, 2001, to June 22, 2001
The June 22, 2001 expiration date would bar acceptance of any applications inconsistent with "A-7.5"
One-Family Residential zoning on the property in the 2000-2200 block of Cooks Lane (more particularly
shown in Attachment "A" to the attached ordinance) and enable the City Council to consider the
rezoning of the property before the moratorium expires.
