AN ORDINANCE AMENDING CHAPTER 3 "AIRPORTS AND
AIRCRAFT" OF THE CODE OF THE CITY OF FORT WORTH (1986),
AS AMENDED, BY CLARIFYING THE LOCATIONS AND CHANGING
THE TIMES AT WHICH. AIRCRAFT ENGINE RUN-UPS WILL BE
ALLOWED AT CITY-OWNED AIRPORTS; ESTABLISHING THAT
VIOLATIONS THEREOF ARE UNLAWFUL AND PUNISHABLE BY A
FINE; AND FURTHER PROVIDING THAT THIS ORDINANCE IS
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS THAT: ~~;

SECTION 1.
Section 3-123(b) ("Engine run-ups") of Chapter 3 ("Airports and Aircraft") of the Code
of the City of Fort Worth, Texas (1986), as subsequently amended (the "Code), is hereby
amended so that such Section shall hereafter read as follows
Sec. 3-123. Aircraft noise.
(b) Engine run-ups It shall be unlawful for any person to conduct an aircraft
maintenance run-up at any airport except at the times set forth m the following schedule:
Sundays, 8 00 A.M. to 10.00 P.M.
Mondays, 6.00 A.M. to 10.00 P.M.
Tuesdays, 6.00 A.M. to 10.00 P.M.
Wednesdays, 6.00 A.M. to 10 00 P.M.
Thursdays, 6 00 A.M. to 10.00 P.M.
Fndays, 6.00 A.M. to 10.00 P.M.
Saturdays, 6.00 A.M. to 10.00 P.M.
In addition, rt shall be unlawful for any person to conduct an aircraft engine run-up within
one hundred (100) feet of any building on the airport. Aircraft engine run-ups at any airport shall
be conducted only at locations at the airport designated by the director for that purpose. A
person conducting an engine run-up shall ensure that other persons, hangars, shops, other
buildings and parked vehicles are not in or likely to be in the path of a propeller or~et blast.
SECTION 2.
In accordance with Section 5 of Ordinance No 10029, as codified at Section 3-2 of the
Code, a violation of this Section 3-123(b), as amended by this Ordinance, shall constitute a
misdemeanor criminal offense punishable by a fine not to exceed Five Hundred Dollars
($500 00)
SECTION 3.
This Ordinance shall be cumulative of all ordinances of the City, except where the
provisions of this Ordinance are m direct conflict with the provisions of such other ordinances, m
which case the conflicting provisions of such other ordinances are hereby repealed.
SECTION 4.
The sections, paragraphs, sentences, clauses and phrases of this Ordinance are severable.
If any portion of this Ordinance is declared illegal or unconstitutional by the valid final judgment
or decree of any court of competent jurisdiction, such illegality or unconstitutionality shall not
affect the legality and enforceability of any of the remaining portions of this Ordinance.
SECTION 5.
After the adoption of this Ordinance and m accordance with Section 2 of Chapter XXV
of the City Charter of the City of Fort Worth, Texas, the City Secretary of the City of Fort Worth
is hereby directed to have this Ordinance published m its entirety two (2) times m the official
newspaper of the City In lieu thereof, the Crty Secretary of the City of Fort Worth may have
descriptive captions or titles that summarize the purpose of this Ordinance and the penalty for
violations thereof published two (2) times in the official newspaper of the City
SECTION 6.
This Ordinance shall be in full force and effect following its adoption and publication as
specified herein.

SUBJECT ORDINANCE AMENDING SECTION 3-123(8) OF THE CITY CODE REGARDING
LOCATIONS AND TIMES OF AIRCRAFT ENGINE RUN-UPS AT CITY-OWNED
AIRPORTS
RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance amending Section 3-123(b) of the
City Code to change the times at which aircraft engine run-ups may be conducted at City-owned
airports
DISCUSSION
An aircraft engine run-up is defined in the City Code as the operation of a stationary aircraft engine
above idle power except to overcome inertia for taxiing Currently, the City Code allows engine run-ups
to be conducted between the hours of 6.00 A.M and 12.00 midnight each day Based on several noise
complaints received from residents near Fort Worth Meacham International Airport, staff recommends
that the hours during which run-ups are allowed be changed to 6.00 A.M to 10.00 P M , Monday
through Saturday, and 8.00 A.IVI to 10.00 P M on Sunday
Pursuant to Section 3-2 of the City Code, violations of this ordinance will be punishable by fines of up to
$500

The Finance Director certifies that this action will have no material effect on City funds.
