HomeMy WebLinkAboutOrdinance 14517ORDINANCE NO. / / s AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF FORT WORTH, BEING ORDINANCE NO 13896, AS AMENDED, CODIFIED AS APPENDIX "A" OF THE CODE OF THE CITY OF FORT WORTH, ESTABLISHING REGULATIONS CONCERNING PERMITTED SIZES FOR ATTACHED ON-PREMISES SIGNS, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, attached on-premises signs covering up to 15% of the area of the wall or facade on which the sign(s) are placed are permitted m the "ER", "E", "FR", "F" and "G" Commercial Districts, the "H" Central Business Distract and the "I", "J" and "K" Industrial Districts, WHEREAS, "attached sign" is defined m the City of Fort Worth zoning ordinance, Ordinance No 13896, as amended, as a sign that •is affixed to, supported by, or painted on a building; WHEREAS, coverage of 15% of the facade of a multi-story building or a building with a sizable footprant could result m a very large attached sign that causes visual clutter, is potentially harmful to property values, causes confusion or distraction to motorasts, and/or has an adverse impact on areas of historical, architectural, scenic or aesthetic value, WHEREAS, rt is advisable to amend on-premises sign regulations to place a maximum size limit on attached on-premises signs, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 Section 6 404(E) of Ordinance No 13896, the zoning ordinance of the City of Fort Worth, "Attached Signs m Commercial and Industrial Districts", is hereby amended to read as follows Unless exempted under the provisions of Section 6 402, the following regulations shall apply to all attached on-premises signs erected m districts "E" Neighborhood Commercial through "K" Heavy Industrial except for signs for large retail stores subject to Section 5 132A(A)(7) 1 The following size limits apply to buildings occupied by a single tenant and to individual tenant spaces in buildings with multiple tenants. One or more attached signs may be erected on each facade of the occupied space The signs may have a total area of 15% of the area of the facade to which the signs are attached, with a maximum aggregate area of 500 square feet per facade. Doors and windows shall be included m calculation of facade area. 2 Signs shall not project more than three feet from the building. or canopy No sign projection shall encroach over public property except as permitted by the Sign Code (Chapter 29 of the City Code) 3 Signs may be installed upon the roof subject to the following conditions a. The sign area shall not exceed {15 percent of the area of the closest facade of the building on which the sign is placed, with a maximum aggregate area of 500 square feet. b The sign shall not extend more than four feet above the roof or top of the parapet wall at the roof, whichever 1S higher c. All roof signs placed upon a building or buildings on one platted lot shall be similar m size, shape, area and design. SECTION 2. Except as expressly amended, all provisions of the Ordinance No 13896, as amended, shall remain in full force and effect. 2 SECTION 3 This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are m direct conflict with the provisions of such ordinances and such Code, m which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent ~unsdichon, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation m this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000 00) for each offense Each day that a violation exists shall constitute a separate offense SECTION 6. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance No 3011, Ordinance No 13896 or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance, 3 and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall .not be affected by this ordinance but may be prosecuted until final disposition by the courts.
