HomeMy WebLinkAboutOrdinance 14622N "-± Ordmance No ~ ~'!~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $3,000,000 SUBJECT TO THE RECEIl'T OF THE GRANT FROM THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR THE PURPOSE OF FUNDING COMPREHENSNE PROGRAMS TO IDENTIFY AND CONTROL LEAD-BASED PAINT IN ELIGIBLE OWNER OCCUPIED AND RENTAL HOMES, MAKING THIS ORDINANCE CUMULATNE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That m addition to those amounts allocated to the various City departments for the Fiscal Year 2000-01 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund m the amount of $3,000,000 subject to the receipt of the grant from the Department of Housmg and Urban Development for the purpose of funding comprehensive programs to identify and control lead-based paint in eligible owner occupied and rental homes. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or Iudgment shall m no way unpair the remaining portions, sections, or parts of sections of this ordinance, which said remauring provisions shall be and remain m full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 14286 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are m direct conflict with such other ordmances and appropriations, in which instance said conflicting provisions of said prior ordmances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. APPROV AS TO FORM AND LEGALITY -- -- ---- Assistant ity Attorney ADOPTED AND EFFECTIVE. ~'( ~`~~ 1 City of Fort Worth, Texas ~1-~Ayar And C,aunc~il Ca~rt~»un~cAt~an DATE REFERENCE NUMBER LOG NAME PAGE 5/15/01 **G-13232 05LEAD 1 of 3 SUBJECT APPLICATION FOR ALEAD-BASED PAINT HAZARD CONTROL PROGRAM GRANT FROM THE U S DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND AUTHORIZATION TO ENTER INTO AGREEMENTS WITH THE CITY OF DENTON, THE FORT WORTH HOUSING AUTHORITY, AND NONPROFIT HOUSING ORGANIZATIONS RECOMMENDATION It is recommended that the City Council Authorize the City Manager to apply for and accept, if awarded, athree-year grant up to $3,000,000 from the Department of Housing and Urban Development (HUD) for the purpose of undertaking comprehensive programs to identify and control lead-based paint hazards in eligible owner- occupied and rental homes, and 2 Authorize the City Manager to enter into agreements or amend such agreements with the City of Denton, the Fort Worth Housing Authority (FWHA), and nonprofit housing organizations within the scope of the program and in compliance with applicable IaN~s and regulations, and 3 Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund up to $3,000,000 subject to receipt of the grant; and 4 Approve the use of $270,000 matching Community Development Block Grant (CDBG) funds as the City's matching portion of the grant DISCUSSION On September 15, 2000, HUD's lead-based paint requirements went into effect. These requirements fall into five categories a) Lead hazard evaluation which includes paint testing or risk assessment; and b) Lead hazard reduction that includes paint stabilization, interim controls, treatments or abatement, safe work practices when performing lead hazard reduction or rehabilitation work, and clearance to confirm that no lead-based paint hazards remain after work is completed, and c) On-going maintenance for some program activities, and d) Notification to occupants of federally-assisted homes built before 1978 on the results of hazard evaluation or reduction activities, and e) Education on lead-based paint hazards and activities to be carried out when children are identified with high blood lead levels City of Fort Worth, Texas ~-~'I~A~a~ And C,aunc~( -C,ai»r»un~cAt~an DATE REFERENCE NUMBER LOG NAME PAGE 5/15/01 **G-13232 05LEAD 2 of 3 SUBJECT APPLICATION FOR ALEAD-BASED PAINT HAZARD CONTROL PROGRAM GRANT FROM THE U S DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND AUTHORIZATION TO ENTER INTO AGREEMENTS WITH THE CITY OF DENTON, THE FORT WORTH HOUSING AUTHORITY, AND NONPROFIT HOUSING ORGANIZATIONS HUD extended the effective date of these regulations to March 15, 2001, and further to April 10, 2001 The City of Fort Worth Housing Department recently applied for a further extension to August 10, 2001 The lead-based paint requirements will affect the following housing programs • Home Improvement Program (generally limited to model block areas), • Emergency Repair (City-wide), • Weatherization (City-wide), • Cowtown Brush-Up (City-wide), and • Homebuyers' Assistance Programs (City-wide) These requirements will also affect similar programs of the City's housing nonprofit partners, as well as Section 8 tenant-based rental units of the FWHA. It is estimated that compliance with the lead-based paint requirements will involve an additional $350 to $15,000 per housing unit. It is therefore critical that the City receive additional funding to cover the additional cost of compliance with these new requirements Otherwise, the number of housing units that can be assisted with available funds by the City, its nonprofit partners, and the FWHA will have to be drastically reduced This will have a negative impact on the City's central city redevelopment goal It is proposed that the City apply fora $3,000,000 grant under HUD's Lead-Based Paint Hazard Control Grant Program to cover compliance with HUD's new requirements over athree-year period This is a highly competitive grant. It is proposed that the Housing Department, as lead agency, partner with the! City and Tarrant County Health Departments, FWHA, housing nonprofit organizations, and the City of Denton These partnerships demonstrate collaboration, which increases the City's chances of being awarded the grant. The City of Denton will be allocated $300,000 out of the $3,000,000 The grant requires a 10% match, or $300,000 for $3,000,000 The City's match requirement should total at least $270,000 (10% of $2,700,000) This will come mainly from CDBG funds, including the purchase of a lead-based paint testing machine ($16,200) and salaries for existing Housing Department staff wh.o will be involved in the Lead-Based Hazard Control Program ($380,393) The partners will also contribute toward the City's match The City of Denton has identified their matching sources amounting to at least $30,000 (10% of $300,000, their share of the grant) The City of Fort Worth's Housing Department will have oversight and monitoring responsibilities for the entire grant. The lead-based paint hazard control program will be, for the most part, implemented in conjunction with the other housing programs mentioned above.
