HomeMy WebLinkAboutOrdinance 14822"~y ORDINANCE NO ~ ~~~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIl'TS AND APPROPRIATIONS 1N THE SPECIAL ASSESSMENT DISTRICT FUND IN THE AMOUNT OF $1,020 00 FROM AVAILABLE FUNDS FOR THE PURPOSE OF PROVIDING FISCAL YEAR 2001-2002 FUNDING FOR FORT WORTH PUBLIC IMPROVEMENT DISTRICT NO. 10; PROVIDING FOR A SEVERABILITY CLAUSE, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT' WORTH, TEXAS. SECTION 1. That in addition to those amoums allocated to thevarious City departments for the Fiscal Year 2001 2002 and in the Budget of the City Manager, there shall alp be increased estimated receipts and appropriations in the Special Assessment District Fund in the amount of $1,020.00 from available funds for the purpose of providing fiscal year 2001-2002 funding for the Fort Worth Public Improvement District No. 10. SECTION 2. Should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in rto way impair the remaining portions, sections, or gaits of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance is the first of such ordinances that shall be cumulative and aIll other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said aontlicting previsions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect and be in full force and effect and after the date of its passage, and it is or ordained. AREA), ADOPT A RESOLUTION ESTABLISHING THE DISTRICT, ADOPT A BUDGET AND SERVICE PLAN, ADOPT A PROPOSED ASSESSMENT ROLL, SET A BENEFIT HEARING DATE FOR FISCAL YEAR 2001- 2002, ADOPT AN ORDINANCE APPROPRIATING CERTAIN FUNDS FOR THE DISTRICT, AND AUTHORIZE THE C1TY MANAGER TO ENTER INTO A CONTRACT FOR MANAGEMENT SERVICES IN THE DISTRICT RECOMMENDATION It is recommended that the City Council 1 Hold a public hearing concerning the following. matters. • The advisability of establishing. the proposed district; and • The general nature of-the proposed improvements and/or services, and • The estimated cost of improvements and/or services, and • The proposed boundaries of the district; and • The proposed method of assessment; and • The proposed apportionment of costs between the improvement district and the City as a whole, and 2. Adjourn such public hearing, and 3 Adopt the attached resolution, which a) Establishes a public improvement district under the Public Improvement District Assessment Act (the Act) (V T C.A., Local Government Code, Section 372.001 et seq) to be known as the Fort Worth Improvement District No 10, and b) Authorizes the City to exercise the powers granted by the Act in connection with the establishment of a public improvement district; and c) Makes certain findings concerning the nature and advisability of the improvements and/or services to be provided by the district, the estimated costs, the boundaries of the district, the method of assessment, and the apportionment of costs between the district and the City as a whole, and d) Adopts the attached budget and service plan for Fiscal Year 2001-2002, which was presented by representatives of signers of the petition for creation of the district; and e) Authorizes the transfer of $1,020 00 for City-owned property from the General Fund to the Special Assessment District Fund, Public Improvement District (PID) No 10, Fiscal Year 2001-2002 operating budget; and 5 Set Tuesday, October 30, 2001, at 10.00 a.m in the City Council Chamber as the time and place of the benefit hearing, and 6 Direct the City Secretary to give notice of the October 30th meeting in accordance with state law;
