AVENUE; VACATING AND EXTINGUISHING A PORTION OF A 16-
FOOT ALLEY IN BLOCK 1, ROSE HILL ADDITION, PROVIDING FOR
REVERSION OF FEE IN SAID LAND, REPEALING ALL ORDINANCES
IN CONFLICT HERE-WITH, AND PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS
SECTION 1.

THAT Modlin Avenue between Haskell. Avenue and Montgomery Street abutting
Lot A-R-1, Block 1, F-W-O-H Addition, Fort Worth, Texas, and Block 1 Zihlman's
Addition, Fort Worth, Texas, and as recorded in Cabinet A, Slide 2465, Plat Records,
Tarrant County, Texas and as more specifically described in Exhibit "A", attached
hereto and incorporated herein by reference, be and the same is vacated and
extinguished
AND FURTHER THAT Haskell Avenue and a portion of Bertrose Avenue, and a
portion of Bunting Avenue located and abutting A-R-1, Block 1, F-W-O-H Addition, Fort
Worth, Texas, and Block 1, Rose Hill Addition, Fort Worth, Texas, Block 4, Rose Hill
Addition, Fort Worth, Texas, and Block 5, West Highlands Addition, Fort Worth, Texas,
as recorded in Volume 309, Page 56, Deed Records of Tarrant County, Texas, and as
more specifically described in Exhibit A, attached hereto and incorporated herein by
reference, be and the same is vacated and extinguished
Addition, Fort Worth, Texas, and as recorded in Volume 204, Page 42, Deed Records,
Tarrant County, Texas and as more specifically described in Exhibit "A", attached
hereto and incorporated herein by reference be and the same is vacated and
extinguished
SECTION 2
That the fee to the land in the above described vacated street rights-of-way and
alley-way are hereby released and shall revert to the adjacent owner as provided by
law
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith are hereby
repealed
SECTION 4.
That this ordinance shall take effect upon adoption

RECOMMENDATION
It is recommended that the City Council adopt the attached ordinance vacating Modlin Avenue between
Haskell Avenue and Montgomery Street; Haskell Avenue between Mattison Avenue and Clarke
Avenue, portions of Bertrose Avenue and Bunting Avenue, and a 16-foot alley in Block 1, Rose Hill
Addition, as shown on the attached Exhibit A.
DISCUSSION
On March 11, 1999 (M&C G-12498), the Fort Worth City Council authorized a land use plan for the
Osteopathic Medical Center of Texas (OMCT) The attached ordinance follows the directive of M&C G-
12498 and allows the OMCT to construct needed facilities while conforming to guidelines protecting the
North Hi-Mount neighborhood This agreement requires the OMCT to construct Bertrose Avenue,
conduct a traffic impact study, physically close Modlin, Mattison, and Bunting Avenues west of Haskell
Avenue, and construct a continuous wall/fence along the western boundary of the OMCT's property
The City agrees to the vacation of portions of Modlin, Bertrose, Bunting and Haskell Avenues
On March 20, 2001 (M&C G-13183), the City Council authorized a temporary closing of specific streets
to enable the OMCT to begin construction of the parking lot. This construction is nearing completion,
and the OMCT is now ready to complete the street vacations and dedication of the right-of-way for, and
construction of, the realligned Bertrose Avenue between Mattison Avenue and Bunting Avenue
Vacating these rights-of-way conforms to the approved zoning and Planned Development/Specific Use
requirements for this area (Zoning Docket Nos. Z-98-177 and SP-98-034) The Plan Commission
approved the Concept Ptan, CP-98-007, and the vacation requests, VA-96-012 and VA-99-028 The
OMCT will re-plat the property dedicating the right-of-way for the new alignment of Bertrose Avenue
between Mattison Avenue and Bunting Avenue along the westside of the new parking lot (FS-99-103)
OMCT is also entering into a Community Facilities Agreement with the City to provide for the
construction of Bertrose Avenue according to agreements between the OMCT, the North Hi-Mount
neighborhood, and the City
The Engineering Department, Real Property Management Division has verified that the value of the
new right-of-way and improvements are equal or exceed the value of the vacated rights-of-way
Reviewing City departments and public utility companies have raised no objections to this request.
