CITY OF FORT WORTH ORDINANCE NO. 1 ~ S ~
JOINT ORDINANCE AND BOUNDARY AGREEMENT
WHEREAS, the City of Keller is a home rule city situated in Tarrant County, Texas,
WHEREAS, the City of Fort Worth is a home rule city situated m Tarrant, Johnson, and
Denton Counties, Texas,
WHEREAS, Fort Worth and Keller share a common boundary;
WHEREAS, the City of Keller owns approximately 28.3 acres of land in Fort Worth
located south of Golden Triangle Blvd. and west of Sports Parkway and more completely
described in Exhibit "A" attached and incorporated by reference (the "Property"), which land
adJoms property m the City of Keller currently used for a municipal sports facility known as
Keller Sports Park;
WHEREAS, the Property is 600 feet wide at its widest point;
WHEREAS, Section 43 031 of the Texas Local Government Code authorizes adJacent
municipalities to make mutually agreeable changes m their boundaries of areas that are less than
1,000 feet in width, and
WHEREAS, the City of Keller and the City of Fort Worth desire to adJust their corporate
boundary lines to .incorporate the Property into the city limits of Keller so that the Property can
be used in conJunction with the Keller Sports Park;
NOW, THEREFORE, BE IT ORDAINED AND MUTUALLY AGREED BY THE
CITY COUNCIL OF THE CITY OF KELLER AND THE CITY COUNCIL OF THE
CITY OF FORT WORTH:

SECTION 1.
Pursuant to Section 43 031 of the Texas Local Government Code, the City of Keller and
the Crty of Fort Worth hereby agree that the boundary between the cities will be changed to
incorporate the Property into the City of Keller, as reflected in Exhibit "B" attached and
incorporated by reference.
SECTION 2.
In accordance with the terms of this Joint Ordinance and Boundary Agreement, the City
of Fort Worth relinquishes to the City of Keller and disannexes and discontinues the Property as
apart of the City of Fort Worth.
SECTION 3.
In accordance with the terms of this Joint Ordinance and Boundary Agreement, the City
of Keller accepts and annexes the Property into its corporate limits.
SECTION 4.
This ordinance shall be cumulative of all provisions of ordinances of the City of Keller
and the City of Fort Worth, except where the provisions of this ordinance are m direct conflict
with the provisions of such ordinances, m which event the conflicting provisions of such
ordinances are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Councils of Keller and Fort Worth that
the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if
any phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent ~unsdiction, such

unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs
and sections of this ordinance, since the same would have been enacted without the incorporation
in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 6.
The City of Keller and the City of Fort Worth covenant and agree to protect, preserve and
defend the herein described boundary adjustment.
SECTION 7
The City of Keller and the City of Fort Worth agree and ordain that the adoption by both
cities of this Joint Ordinance and Boundary Agreement, and the boundary change resulting
therefrom, do not mitigate or diminish in any way the rights that either party may have, at law or
in equity, to challenge or contest any other annexations, attempted annexations or extraterntonal
~unsdiction claims made by the other party
SECTION 8.
This Joint Ordinance and Boundary Agreement shall become effective and shall become
a binding agreement upon the City of Keller and the City of Fort Worth by the adoption of same
in regular open city council meetings of the City of Keller and the City of Fort Worth.
SECTION 9.
This Joint Ordinance and Boundary Agreement, upon adoption by both cities, shall be
executed in duplicate originals by the Mayor of each City

OF LAND OUT OF THE JESSIE BILLINGSLEY SURVEY LOCATED SOUTH OF GOLDEN
TRIANGLE BOULEVARD AND WEST OF SPORTS PARKWAY
RECOMMENDATION
It is .recommended that the City Council
1 Approve the attached Joint Ordinance and Boundary Agreement with the City of Keller whereby the
City of Fort Worth disannexes approximately 28 3 acres of land out of the Jessie Billingsley Survey,
located south of Golden Triangle Boulevard and west of Sports Parkway; and
2 Authorize the Mayor to execute the attached Joint Ordinance and Boundary Agreement.
DISCUSSION
The City of Keller owns approximately 28 3 acres of land south of Golden Triangle Boulevard and west
of Sports Parkway that adjoins the Keller Sports Park. The City of Keller has requested that the
boundaries between Fort Worth and Keller be adjusted to incorporate the property into the city limits of
Keller for use in conjunction with the Keller Sports Park.
On October 16, 2001, the Keller City Council approved on first reading the Joint Ordinance and
Boundary Agreement, and is scheduled for second reading and adoption on November 13, 2001
Approval of the Joint Ordinance and Boundary Agreement by both cities will effectuate disannexation
and release of the subject property by the City of Fort Worth and annexation of the property by the City
of Keller
The property is currently located in COUNCIL DISTRICT 4
