Ordinance No AN ORDINANCE INCREASING THE ESTIMATED RECEII'TS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $16,410 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING CHANGE ORDER NO 1 TO THE CONTRACT WITH WILLIAM J SCHULTZ, INC., D/B/A CIRCLE "C" CONSTRUCTION FOR CONSTRUCTION OF SANITARY SEWER MAINS D 104D, D 105, D l OSA, AND D 109 REHABILITATION PART II AND WATER LINE IMPROVEMENTS IN HOUSTON STREET AND THROCKMORTON STREET, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 2000-01 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $16,410 from available funds for the purpose of funding Change Order No. 1 to the contract with William J Schultz, Inc., d/b/a Circle "C" Construction for construction of Sanitary Sewer Mains D104D, D105, DlOSA and D109 Rehabilitation Part II and water line improvements in Houston Street and Throckmorton Street. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 14286 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, inwhich instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. During construction of the water line in Houston Street, the contractor found railroad ties from an old trolley track within its trench line The presence of these railroad ties forced the contractor to widen the permanent paving repair beyond what is normally required The contractor also encountered a natural gas service line that was not identified on the plans. In order to meet the deadlines established, the contractor provided a trench to relocate the natural gas service line and is requesting payment for this additional work.
