HomeMy WebLinkAboutOrdinance 14843`~ • .+ Ordinance No. /~~~~ AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $356,986 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A SENIOR Di/PUTY CITY MARSHAL AND EIGHT DEPUTY CITY MARSHAL POSITIONS DEDICATED TO SECURITY AT MUNICIPAL COURT, MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS. SECTION 1 That in addition to those amounts allocated to the various City departments for the Fiscal Year 2001-02 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $356,986 from available funds for the purpose of funding a Senior Deputy Marshal and eight Deputy City Marshal positions dedicated to security at Municipal Court. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 14745 and all other ordinances and appropriations amending the same except ui those mstances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the City Manager to transfer $487,460 12 in FY2001 from the Municipal Court Building Security Fund to the General Fund DISCUSSION During the 1995 regular session, the Texas Legislature adopted an amendment to Article 102.017 of the Code of Criminal Procedure to allow the governing body of a municipality to create, by ordinance, a Municipal Court Building Security Fund Defendants convicted in trial for a misdemeanor offense in Municipal Court are required to pay a $3.00 security fee as a cost of the court. On October 10, 1995, Ordinance No 12204 was approved by the City Council to create the Municipal Court Building Security Fund. The fund can only be used for the purposes of providing security services for buildings that house a municipal court. This can include the purchase of parcel x-ray machines, hand-held and walk-through metal detectors, security personnel providing security services and continuing education on security issues for court and security personnel On June 20, 2000 (M&C G-12942), the City Council approved the implementation of the Municipal Court Building Security Enhancement Plan The plan authorized a Senior Deputy City Marshal and eight Deputy City Marshal positions dedicated to building security functions. Initial funding, as appropriated, covered the 4th Quarter FY1999-2000 operating costs. The FY2000- 2001 adopted budget estimated $313,089 00 for Building Security operations, however, actual salaries and departmental support total $487,460 12. The Municipal Court Building Security Fund balance, currently totaling $1,145,625 00, is sufficient to cover the additional expenditures, and provide for full reimbursement of all FY2000-2001 court security expenditures.
