HomeMy WebLinkAboutOrdinance 14746ORDINANCE NO AN ORDINANCE ADJUSTING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS AT EACH CLASSIFICATION (RANK) IN THE FIRE DEPARTMENT FOR FISCAL YEAR 2000-2001, PROVIDING FOR THE CREATION OF ONE ADDITIONAL BATTALION CHIEF POSITION, PROVIDING A STATEMENT OF PURPOSE AND INTENT, PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE, PROVIDING A SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the most recent ordinance concerning the authorized and budgeted positions for the Fire Department, Ordinance No 14715 adopted July 24, 2001(M+C G- 13264), adjusted the Department's civil service staffing as follows Deputy Chiefs 3 Battalion Chiefs 23 Captains 79 Lieutenants 110 Engineers 176 Firefighters 355 TOTAL 746 WHEREAS, the Fire Chief now requests that the Council readjust the total authorized number of Fire Department civil service positions at the classification (rank) of Battalion Chief for the remainder of the 2000-2001 Fiscal Year, in conformity with the changes set forth below; and WHEREAS, pursuant to Chapter 143 021 (a), Texas Local Government Code, the City Council may prescribe and/or adjust the authorized number of positions in each classification (rank) by ordinance, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1 That, effective immediately upon the adoption of this ordinance, the following positions shall be the only civil service positions in each classification (rank) authorized in the City of Fort Worth Fire Department for the remainder of the Fiscal Year 2000-2001, or until modified by subsequent ordinance ,. Deputy Chiefs 3 Battalion Chiefs 24* Captains 79 Lieutenants 110 Engineers 176 Firefighters 355 TOTAL 747 * Creates 1 new position SECTION 2 The "Mayor and Council Communication" memorandum which is presented contemporaneously with this ordinance is hereby expressly incorporated herein by reference for further clarification and explanation of the purposes and intent of the City Council in the adoption of this ordinance SECTION 3 It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs or sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section SECTION 4 This ordinance shall take effect upon adoption _~ APPROVED AS TO FORM AND LEGALITY City orney Date ~ L ADOPTED AND EFFECTIVE ~ ` ~ City of Fort Worth, Texas M,~A~oe And Council Comman~cAtion DATE REFERENCE NUMBER LOG NAME PAGE 8/14/01 **G-13338 36ADJUST 1 of 2 SUBJECT ORDINANCE ADJUSTING THE AUTHORIZED CIVIL SERVICE STAFFING IN THE FIRE DEPARTMENT BY ADDING ONE BATTALION CHIEF POSITION RECOMMENDATION It is recommended that the City Council adopt the attached ordinance specifying the number of authorized positions in the Fire Department, thereby effectively increasing the number of authorized battalion chief positions in the Fire Department by one DISCUSSION The Fire Department proposes that one battalion chief position be added to the authorized civil service staffing to comply with the City of Fort Worth Firefighters and Police Officers Civil Service Rules and Regulations The Fire Department indefinitely suspended (terminated} a battalion chief in August 2000 In accordance with state law and local rules, the appropriate promotions were made within the Fire Department to fill the position vacated as a result of that termination The suspended employee appealed his suspension to a third party hearing examiner Subsequently, an agreement was reached with the employee, and an order was received from the hearing examiner to reinstate the employee with an effective date after a 90-day unpaid suspension In accordance with recent court decisions and civil service law, an additional battalion chief position must be created into which the suspended employee will be assigned After the position is created, and the reinstatement completed, a separate Mayor and Council Communication and ordinance will be forwarded to the City Council to reduce the number of battalion chief positions in the Fire Department by one This wi11 trigger a series of demotions The persons being demoted will be the most recently promoted battalion chief, captain, lieutenant, and engineer They will be placed on a reinstatement list that will be in effect until the persons are promoted, or for one year, whichever comes first.
