I~6g AN ORDINANCE EXTENDING A MORATORIUM ON ACCEPTANCE OF CONCEPT PLANS, PRELIMINARY PLATS, UNIFIED RESIDENTIAL DEVELOPMENT SITE PLANS, AND APPLICATIONS FOR BUILDING PERMITS AND OTHER DEVELOPMENT PERMITS, EXCEPT FOR DEVELOPMENT PERMITS CONSISTENT WITH "A-5" ONE-FAMILY RESIDENTIAL ZONING, FOR PROPERTIES LOCATED IN THE VICINITY OF THE WESTERN SHORE OF LAKE ARLINGTON, SOUTH OF THE 6100 BLOCK OF RAMEY AVENUE, EAST OF THE 2800-5300 BLOCKS OF INTERSTATE LOOP 820 AND NORTH OF INERSTATE 20, PENDING CONSIDERATION OF REZONING OF SUCH PROPERTIES, PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on January 16, 2001, the City Council approved Mayor and Council Communication G-13131 authorizing the City Manager to mrtiate rezoning of properties located in the vicinity of the western shore of Lake Arlington, south of the 6100 b1QCk of Ramey Avenue, east of the 2800-5300 blocks of Interstate Loop 820 and north of Interstate 20 (the Property), to "A-5" One-Family Residential or a more restrictive single-family designation m conformance with the 2000 Comprehensive Plan, WHEREAS, the City Council enacted Ordinance No 14491 on January 16, 2001, establishing a 120-day moratorium on the acceptance of concept plans, preliminary plats, Unified Residential Development site plans, and applications for building permits and other development permits for the development of the Property; WHEREAS, on March 14, 2001 the Zoning Commission continued the hearing on the Property until May 9, 2001 to allow for further study and to give the City staff additional time to contact all property owners affected by the proposed rezoning of the Property, WHEREAS, the City Council enacted Ordinance No 14611 on May 5, 2001, extending the moratorium on the acceptance of concept plans, preliminary plats, Unified Residential Development site plans, and applications for building permits and other development permits for the development of the Property until June 22, 2001, WHEREAS, on May 9, 2001, the Zoning Commission recommended that Tracts 7, 12, 13, 14, 21 and 25 of the Property be denied for rezoning to "A-5", "A-7.5" and "A-10" One- Family; WHEREAS, the remaining Tracts of the Property were continued by the Zomng Commission for further consideration until August 8, 2001 to allow the Commission time to review legislation pending before the Texas Legislature concerning rezoning of property; WHEREAS, on June 12, 2001, the City Council, at rts regularly scheduled meeting, denied for rezoning Tracts 7, 12, 13, 14, 21 and 25 of the Property to "A-5", "A-7.5" and "A-10" One-Family; WHEREAS, said remaining tracts of the Property are located m the vicinity of the western shore of Lake Arlington, south of the 6100 block of Ramey Avenue, east of the 2800- 5300 blocks of Interstate Loop 820 and north of Interstate 20 and are shown on Attachment "A" and depicted in the map attached as Attachment "B", WHEREAS, it is advisable to extend the moratorium to September 21, 2001, to allow the Zomng Commission an opportunity to conduct a hearing and make recommendations to the City Council and to give the City Council time to consider rezoning those remaining tracts of the Property as shown on Attachment "A" and depicted on the map attached as Attachment "B", to "A-5", "A-7 5" or "A-10" One-Family Residential, WHEREAS, all findings m Ordinance No 14491 are reaffirmed, 2 :~ NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, AS FOLLOWS SECTION 1. The expiration of the moratonum on acceptance of concept plans, preliminary plats, unified residential development site plans, and applications for building permits and other development perrnits for the property located in the vicinity of the western shore of Lake Arlington, south of the 6100 block of Ramey Avenue, east of the 2800-5300 blocks of Interstate Loop 820 and north of Interstate 20, more particularly shown in Attachment "A" and depicted on the map attached as Attachment "B", enacted pursuant to Ordinance No 14491, is hereby extended from June 22, 2001 to September 21, 2001 at 11 59 p.m., or until the City Council terminates the moratonum, whichever occurs first. SECTION 2. All provisions of Ordinance No 14491, with the exception of the expiration date extended by Section 1 of this Ordinance, shall remain in full force and effect. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of a court of competent ~unsdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been 3 J o enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. City of Fort Worth, Texas ~11~A~ar And Caunc~l L,ant~»un~cAt~an DATE REFERENCE NUMBER LOG NAME PAGE 6/19/01 G-13279 12MORAT 1 of 2 SUBJECT ADOPTION OF ORDINANCE EXTENDING MORATORIUM ON ACCEPTANCE OF APPLICATIONS FOR DEVELOPMENT 4F CERTAIN PROPERTY IN THE VICINITY OF THE WESTERN SHORE OF LAKE ARLINGTON, SOUTH OF THE 6100 BLOCK OF RAMEY AVENUE, EAST OF THE 2800-5300 BLOCKS OF INTERSTATE LOOP 820 AND NORTH OF INTERSTATE 20 RECOMMENDATION It is recommended that the City Council adopt the attached ordinance extending the moratorium to September 21, 2001, for acceptance of concept plans, preliminary plats, Unified Residential Development site plans and applications for building permits or other development permits for property located generally along and near the western shore of Lake Arlington, south of the 6100 block of Ramey Avenue, east of the 2800-5300 blocks of Interstate Loop 820, and north of Interstate 20 DISCUSSION On January 16, 2001 (M&C G-13131), the City Council authorized the City Manager to initiate rezoning of the property in the vicinity of the western shore of Lake Arlington, south of the 6100 block of Ramey Avenue, east of the 2800-5300 blocks of Interstate Loop 820 and north of Interstate 20 (the Property) to "A-5" One-Family Residential or a more restrictive residential designation, which would permit development of one-family residential dwellings and other uses such as churches and schools On January 16, 2001 (M&C G-13132), the City Council also adopted Ordinance No 14491, establishing a 120-day moratorium on the acceptance of applications for development of the Property in order to maintain the status quo pending consideration of rezoning the property to "A-5" One-Family Residential consistent with the Comprehensive Plan On March 14, 2001, the Zoning Commission continued the hearing on this Property until May 9, 2001, to allow for further study and to give City staff additional time to contact all property owners affected by the proposed rezoning of the Property On May 9, 2001, the Zoning Commission, by a vote of 7-0, recommended that Tracts 7, 12, 13, 14, 21 and 25 be denied for rezoning to "A-5", "A-7 5" and "A-10" One-Family The City Council agreed with the recommendation of the Zoning Commission, and these same tracts were denied for rezoning to "A-5", "A-7 5" and "A-10" One-Family at the City Council's regularly scheduled meeting on June 12, 2001 The remaining tracts, as shown on Attachment "A" and depicted on the attached map as Attachment "B" to the Ordinance, were continued by the Zoning Commission for further consideration until August 8, 2001, to allow the Zoning Commission time to review legislation pending before the Texas.
